vessels coming into said port for the purposes of commerce, should
contribute their proportion of an additional allowance, in conformity
to the usages of our sister states and foreign nations; therefore, |
Allowance to harbour
master. |
2. BE IT ENACTED, by the General Assembly
of Maryland, That
it shall and may be lawful for the harbour-master of the said port
to ask, demand and receive, of and from the captain and commander
of every foreign vessel, coming into the said port for the purposes
of trade and commerce, the sum of five dollars, as an additional
compensation to the said harbour-master for his care and
diligence in the regulation of the said harbour and providing a proper
station for said vessels. |

3. AND BE IT ENACTED, That in case of refusal
or delay in
making such payment, it shall and may be lawful for the said harbour-master
to sue for and recover the same, before a single magistrate,
as small debts out of court are now recovered. |

A Supplement to an act, (a) entitled, An act to establish
a Market,
and to build a Market-House, in the Western Precincts
of Baltimore,

Commissioners appointed,
and empowered
to make
rules, &c. |
1. BE IT ENACTED, That Daniel Lammot, Christopher
Johnson,
Ebenezer Finley, Lewis Pascault, John S. Horn, Luke Tiernan
and John Kennedy, be and are hereby appointed commissioners
(b) of the western precincts market, and the said commissioners,
or the major part of them, and their successors duly chosen, are
hereby authorised and empowered, from time to time, to make rules
and regulations for the good order, government and well being, of
said market, and to establish fines, forfeitures and penalties,
upon each and every person who may offend against such rules and
regulations, provided no fine shall exceed five dollars for each offence,
and in their discretion to remit the same; Provided always, that
the said rules and regulations be published at least three several
weeks in one of the daily newspapers in the city of Baltimore, and
posted in several places of the said market-house, before they be
carried into effect; and fill power and authority is hereby granted
to said commissioners, in the name of The Commissioners of the
Western Precincts Market, to recover before a single justice of
the peace all fines, forfeitures and penalties, as small debts are recoverable,
and in like manner to bring action or actions in Baltimore
county court against any person or persons who may do any
injury to the said market-house, stalls, or other property belonging
or attached to said market; all fines and forfeitures to be applied to
the use of said market.
(b) By 1811, ch. 18, other commissioners
were constituted, and new regulations
established for electing those in future; but by 1817, ch. 148, all the
powers,
&c. granted to the commissioners herein mentioned, are vested in the
Mayor and
City Council.

What stalls not to
be charged. |
4. AND BE IT ENACTED, That it shall not be
lawful for said commissioners
to make any charge, or claim any rent, for any stalls to
be erected or established under the sheds, and without the shambles, |
