of any ticket or tickets in said lottery, give their bond to the state
of Maryland, in the penalty of four thousand dollars, conditioned
that they will well and truly apply so much of the money arising
therefrom, within six months after the drawing of said lottery shall
commence, as will satisfy the fortunate adventurers for prizes drawn
by them, and after deducting the necessary expenses incurred in 
said lottery, shall, within twelve months from the time of the drawing
of said lottery shall commence, cause the said road to be opened
and cleared out in the best manner the sum of money raised by
the said lottery will admit.

CHAP. 38.

    2.  AND BE IT ENACTED, That it shall be the duty of said commissioners,
before they act as such, to lodge such bond in the clerk's
office of Frederick county, there to be recorded, and upon such bond,
or any office copy thereof, suit or suits may be instituted against
the obligors therein, or any of them, or their or any of their legal
representatives, for any breach or non-compliance with the condition
of the same.

                                        CHAP. XXXIX.
An Act to compel the Registers of Wills in the several Counties herein
    mentioned to keep each his Office at the seat of justice in the County
    for which he shall Register.

Passed Jan. 12, 1805.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
from and after the passage of this act, it shall be, and is hereby declared
to be, the duty of the registers of wills for the time being of
the several counties herein mentioned, to wit:  Saint-Mary's, Kent,
Charles, Talbot, Dorchester, Worcester, Harford, Washington
and Montgomery counties, to keep each his office at the place where
the county court is held for his respective county, and there to deposit
and keep all the papers belonging to his said office.

    2.  AND BE IT ENACTED, That it shall also be the duty of the
said registers to give daily attendance at their offices, either in person
or by deputy, for the purpose of discharging the duties incident
thereto, except on Sundays, and unless prevented by sickness, or
some unavoidable accident.

    3.  PROVIDED NEVERTHELESS, AND BE IT ENACTED, That nothing
herein contained shall be construed, or have effect in any manner,
to authorise a deputy to transact any part of the business or
duties of the said office which is or may by law be required to be
executed by the register in person, and it is hereby declared to be
the duty of the said registers, at all times after the passage of this
act, to attend at their respective offices, in person, unless prevented
as aforesaid, at least two days in every week.
