not to be affected
by any warrant to
be issued before
end of next session,
&c.

                APPENDIX——RESOLUTIONS.

                                        No. 6.
    RESOLVED, That no land to the westward of Fort Cumberland,
for which certificate hath been heretofore returned and patent issued,
shall be affected by any warrant to be issued before the end of the
next session of assembly, or by any common warrant already issued
and not located on such land, except for the use and benefit
of the person or persons claiming under such patent.


Gunpowder, &c.
in magazine in
Frederick authorised
to be sold,
&c.
                                        No. 7.
    RESOLVED, That Valentine Brother, senior, of Frederick-town,
be and he is hereby authorised to sell and dispose of, under the direction
of the governor and council, on the best possible terms, for
the benefit of the state, all gunpowder and brimstone now in the
magazine at Frederick, and all such arms and accoutrements in the
armoury at Frederick as are unfit for use without previous repairs;
and the said Valentine Brother shall be entitled to a commission
of three per cent. on the amount of such sales, as a compensation
for his services; provided, that before he shall proceed to make any
sale as aforesaid, he shall give bond to the state, with such security
as the governor and council shall approve, conditioned for the
faithful discharge of the trust hereby committed to him, and for the
payment into the treasury of the western shore of all monies by
him received in virtue thereof, within three months next after such
receipts, after deducting the amount of his said commissions, which
shall be ascertained by the auditor-general; provided also, that nothing
herein contained shall be construed to prevent the governor
and council from retaining, for the use of the state, such of the
arms as may not want repairs, or only small repairs, and so much
of the powder as may not be damaged, as they, in their discretion,
may think necessary, which said arms and powder shall be selected
by such person as the governor and council shall appoint for that
purpose.

If necessary to
transport same,
governor authorised 
to draw upon
the treasury, &c.
                                        No. 8.
    RESOLVED, That in case it shall be deemed necessary to transport
the said powder to Baltimore-town, or other place, for sale,
or to furnish casks for the purpose of containing and securing the
same, the governor and council shall be authorised to draw upon
the treasury in favour of the said Valentine Brother, for such sum
of money as will enable him to procure the said casks, and to effect
the said transportation, an account of the application of which money
shall be rendered by the said Valentine Brother to the auditor-general,
and the surplus unexpended, if any, shall be paid by him
into the treasury, and his aforesaid bond shall be liable therefor.

Arms, &c. unfit
for use in Annapolis
and Easton, to
be sold.
                                        No. 9.
    RESOLVED, That the governor and council be authorised and
requested to cause such of the public arms and accoutrements in
the armouries at Annapolis and Easton, as may be unfit for use
without previous repairs, to be sold for the benefit of the state, and
to take all such measures as may be necessary for accomplishing
that object, and for bringing the amount of such sales into the treasury.
