            INDEX TO THE LAWS.
 

—The court empowered to decree a sale thereon if
for the advantage of the infants, &c.

    Mounted.  See Militia.

    Removal of prisoners authorised in case of infection,

NOTE.  The act of 1799, ch. 79, s. 10, directed, that where an
injunction should issue to prevent a sheriff, &c. from selling personal
property taken in execution, he should deliver back the property to
the party, &c.

    Allowance on, to juries, coroner and constables,
    In cases of inquest for a forcible entry, &c. bond to
be given in the penalty and with security as adjudged
by the court, &c, for payment of all costs and damages
incurred by the delay of the proceedings, according
to the decision,

    And return, fees on, allowed to justices of the peace,

    An act for the relief of sundry insolvent debtors,
    Application authorised to be made by either of the
debtors therein named to the county courts, or to any
judge thereof, in case of actual confinement,
—The application to be in writing, offering to deliver
to the use of his creditors all his property real, personal
and mixed, (the necessary wearing apparel and
bedding of himself and his family excepted,) to which
he is in any way entitled,
—A schedule thereof, with a list of creditors, on oath
or affirmation, as far as the petitioner can ascertain
them, to be annexed,
    The court to direct personal notice to be given to the
creditors who can be served therewith, or their agents
or attornies,
—Or direct notice to be advertised in the county,
or in some newspaper, for such time as they may think
proper,
—On the appearance of the creditor, or neglect to
appear, on notice, the court to administer to the debtor
the oath therein prescribed,
—The court thereupon to name as trustee for the
benefit of the creditors, such person as a majority in
value, their agents, &c. should recommend,
—In case of their nonattendance such person as
might be thought proper,
    The court to be satisfied that the petitioner had resided
in the state the two preceding years,
    The person to produce, at the time of petitioning, the
assent in writing of his creditors to the amount of two
thirds in value,
—Foreign creditors not residing, and not having
agents, &c. within the United States, not considered
within the meaning of this clause,
—The court (or a judge in the recess,) empowered
without such assent to discharge the person only,
    Bond to be given by the trustee, in such penalty as
the court shall direct, and recorded in the office of the
county court,
—On refusal or neglect to give bond, or on removal
of the trustee, another to be appointed by the court
and vested with all the rights, &c.
    On the petitioning debtor executing a deed to the
trustee, and delivering all his property, &c. according
to the oath before taken, the court on being certified
thereof, to order that the said debtor shall be discharged
