INDEX TO THE LAWS.
Directions concerning executions issued
from the
late general court, and not returned to the court of
appeals,
Concerning executions from the court of appeals
on judgments in the late general court,
Sheriffs, coroners or constables,
on serving writs of
capias ad satisfaciendum, bound to accept payment
as
on writs of fieri facias, which shall be valid
against
the complainants,
Execution stay of, provision concerning
the embargo
under the act of congress,
Execution may be stayed twelve months,
on judgments
by a justice of the peace, for any sum exceeding
ten pounds, by supersedeas, within sixty days,
Copies of judgments to be furnished
by the justice
rendering them, on which execution may be issued by
any other justice,
Directions as to executions under the act of 1808,
ch. 19. (which had expired,)
Where reparation is adjudged under
this act, and
not made, execution may be issued against the property
of the convicted person, for the value,
Executions issued, or to be issued,
out of the court
of appeals, upon any judgment or decree therein, to be
valid, &c. in the same manner as those issued from
any
court of law,
The court of appeals vested with the like and
similar powers with respect to writs of execution, which
the late general court possessed or exercised,
Equitable estates or interests in
lands, &c. liable to
sale under writs of fieri facias,
Where a judgment confessed before
a justice of the
peace with stay of execution, has been assigned, no
execution to issue until there has been a demand by the
assignee from the principal debtor,
But not necessary, if such debtor shall have removed
since the judgment from his then place of residence,
Where goods are returned taken and
unsold, and the
sheriff, &c. shall die before a sale, the court may
issue
a venditioni exponas to the sheriff, &c. where
the goods
lie, reciting specially the circumstances,
Such sheriff to take the property, make the sale,
and return the same,
Liable to be proceeded against, and his bond answerable
as in other cases,
The schedule to be valid, as if by the former sheriff,
&c.
A deed to be executed in like manner,
Where a sheriff, &c. has made
sale, and died without
executing a deed, the court may direct the sheriff, &c.
for the time being, to execute such deed,
In case of the death of a sheriff,
&c. without making
sale, his executor, &c. to receive only half the
poundage fees, and the next sheriff, &c. making sale,
the other half,
In case of death before the return
day, the plaintiff
may procure a duplicate, or (after the return day) a
new writ to the then sheriff, &c. who shall proceed
thereon,
The executors, &c. of the first sheriff so dying,
not to receive any poundage or other fees,
What shall be due and legal notice
of
sales,
Where the sheriff, &c. has arrested
any person, and
died before the return day, the sheriff, &c. for
the time
being may, on the same writ, again arrest the person
as if not before taken, |
