    1802.                                 LAWS OF MARYLAND.

swine, in order to ascertain the owner or owners thereof; and in
case the owner or owners of such swine shall not make claim to
such swine within the space of seven days thereafter, and pay him
the sum of two dollars, if an inhabitant, or the sum of one dollar, if
not an inhabitant, as the case may be, then the said patroller shall
also dispose of the same at public sale to the highest bidder, and the
money arising from the sale thereof shall be paid over as aforesaid
except the sum aforesaid.

    3.  AND BE IT ENACTED, That if the patroller of said town
shall neglect or refuse to execute any of the duties imposed on him
by this act, he shall forfeit and pay to the overseer of the streets
aforesaid the sum of five dollars for each and every omission of his
said duty, to be recovered by the said overseer before any justice of
the peace for Somerset county as other small debts are recovered,
and in case of such neglect or refusal by the said patroller to do the
duties imposed on him by this act, then it shall be the duty of the
constable of said town to execute such duties in the same manner as
the said patroller is authorised to do, and shall be allowed the same
compensation for his trouble, and shall forfeit the same penalty in 
case of neglect or refusal to act, to be paid and recovered as before
directed by this act.

each day he may
keep them thereafter.
    4.  AND BE IT ENACTED, That it shall and may be lawful for the
said patroller or constable, as the case may be, when any of the
swine or hogs so taken up and confined shall be sold, or redeemed
by the owner, to receive and retain the further sum of six cents for
each and every day he shall keep the said swine or hogs, to be paid
out of the proceeds of any monies which may be produced by said
sale, or to be paid by the owner as aforesaid.

    5.  AND BE IT ENACTED, That all monies paid over and received
by the overseer of the streets aforesaid, shall be applied by
him towards repairing and keeping in order the streets of said town.

A Supplement to the act, * entitled, An act to lay out a Road from
    Aquila Tarman's Tavern to Thomas Cockey's Mill, and from
    the said Mill to the Road called The Deer Park Road.

Preamble.     WHEREAS Samuel Wheeler, of Baltimore county, by his petition
to this general assembly hath set forth, that the damages assessed
by the commissioners named in the act to which this is a supplement,
are not sufficient to indemnify him for the injury sustained
by the location of the road mentioned in the said original act
through his land, and praying that a jury may be summoned to ascertain
the said damages upon oath; and the prayer of the said petition
being reasonable; therefore,

    2.  BE IT ENACTED, by the General Assembly of Maryland, That
