APPEALS

 

            INDEX TO THE LAWS.

    Directions concerning attachments with clause of
scire facias, on judgments in the late general court
and in the court of appeals, to be issued and made returnable
to the county courts,
    In cases of writs of error coram nobis, before the
court of appeals, where it may be necessary to try any
fact put in issue, the record to be transmitted to the
county court for trial,
    The suit therein mentioned to be proceeded in, &c.
    Writs of error from judgments in the late general
court to be prosecuted in the court of appeals, &c.
    On appeal or writ of error from the late general
court, the proceedings to be made up, and transmitted
in the usual manner,
    Proceedings on the death of a party, after a cause is
put under rule argument, having an attorney in court,
    See Abatement.
—The bond and the securities therein liable as if the
appellant were alive at the time of the judgment,
    Compensation allowed to the criers and the sheriff
appointed to keep order in the court,
—The judges, or a majority, to certify the number of
days, and payment to be made by the treasurer,
    Appeals or writs of error not to be prosecuted on
any judgment or decree in the late general court, or
in the county courts, after three years,
—Proviso as to judgments or decrees before rendered,
    The clerks directed to record all deeds or extracts
required by law to be recorded as in the late general
court,
—To receive the same fees as the county clerks for
the like services,
    Any person committed, &c. may in vacation complain
to a judge of the court of appeals, who may
award habeas corpus,
—On refusal, made liable to the action of the party
injured,
    Writs of error may be amended and made agreeable
to the record,
    If there should be sufficient matter of substance in
the record, so as to proceed thereon, the same shall not
be reversed or dismissed for want of form, or for variance,
&c. and the court may permit any entry to be
made which might have been made after verdict in the
court below,
    The clerks required to report annually to the assembly
on or before the first Monday in December, the
duration of every term, and the number of days that
the judges respectively shall attend,
—Penalty on failure, and allowance for the service,
    Executions issued, or to be issued, out of the court
if appeals, upon any judgment or decree therein, to be
valid, &c. in the same manner as those issued from any
court of law,
—The court of appeals vested with the like and similar
powers with respect to writs of execution, which
the late general court possessed or exercised,
    No judgment to be reversed because the verdict was
rendered and the judgment entered for a greater sum
than the damages laid in the declaration,
—Amendment may be made by entering a release
upon the record of the excess of damages, and the court
to proceed thereon, &c.
    Certain cases, in which the court may direct such
judgments to be entered as the nature of the amendment
may require,
    An appeal from the judgment of a county court may
be entered with the clerk, and the same proceedings
had thereon as if granted by the court while sitting,
