as fines are laid and recovered against supervisors by section
nine, the same to be applied accordingly.

    1817.

CHAP. 110.

    16.  AND BE IT ENACTED, That for the purpose of refunding
the road tax on owners of water mills, the levy court shall allow
each owner of a water mill, who shall keep up a road over the same
as aforesaid, such sum as the court may deem equal to their road
tax, the same to be allowed in the levy list.
To be allowed
therefor.
    17.  AND BE IT ENACTED, That it shall be the duty of each supervisor
to direct the hands what tools or implements they shall
carry on the road to work with, and to appoint an early hour in
each day to commence working on the road, and to continue the
hands, when necessary, to a late hour in each day, and to see that
each hand does his duty on the road; any person neglecting to meet
and refusing to obey the reasonable commands of the supervisor
as aforesaid, said hand's wages shall be forfeited for that day, and
such hand, or the owner of such hand, or person under whom such
hand may be sent, shall moreover be liable to be fined not exceeding
one dollar and fifty cents, to be recovered and applied as in section
six, and the supervisor shall not be obliged to return the labour
of such person to the levy court, provided a fine has been laid
for the day.
Duty of supervisors.
    18.  AND BE IT ENACTED, That each supervisor may be fined
not exceeding ten dollars for wilfully neglecting to return the services
done, or allowance to each person, under this act, which fine
may be recovered by each person entitled, before a justice of the
peace, as small debts are recoverable.

    19.  AND BE IT ENACTED, That any justice of the peace shall be
authorised and empowered to receive all fines imposed by this act,
(except those which supervisors are to receive) and shall pay over
the same to the levy court, under the penalty of treble the amount
thereof, and the supervisor shall also pay over to the levy court the
amount they may respectively receive, under the like penalty, to be
recovered in the county court for money had and received, under
the direction of the said levy court, in the name of the state, to be
applied to the county charges.

    20.  AND BE IT ENACTED, That any justice of the peace may lay
any of the fines aforesaid, and give judgment for the same, and
issue execution thereon, as in case of small debts.
Justice may give
judgment.
    21.  AND BE IT ENACTED, That if any person or persons shall
alter, change, obstruct, or encroach upon, any of the said roads, or
cut down, destroy, or purposely injure, any of the bridges or causeways,
such person or persons, on being thereof convicted in the
county court, shall be fined at the discretion of the said court, in
a sum not exceeding fifty dollars, to be applied towards defraying
the county charges.

    22.  AND BE IT ENACTED, That if any person or persons shall
wish to alter, change or straighten, any part of the public roads in
said county, they shall petition the levy court of said county, who
shall appoint not more than five nor less than three judicious men of
said county, not relating to the party applying for such alteration,
as commissioners, who shall view the old road and the place where
the new road is proposed to run, or wished to be made; and if the
said commissioners, or a majority of them, are of opinion that it
would not be a disadvantage to the community at large, they, or a
