CHAP. 76.

                                LAWS OF MARYLAND.

shall be allowed two dollars per day for each and every day he
shall be employed by the commissioners for the purpose aforesaid.

Expenses to be
paid by proprietors.
    8.  AND BE IT ENACTED, That all expenses incurred in the execution
of this act shall be paid by the proprietors, in the proportion
to the number of lots they may severally own or posses.
Commissioners to 
take an oath.
    9.  AND BE IT ENACTED, That before any commissioner or surveyor
shall proceed to the execution of the duties required of them
by this act, he shall take an oath or affirmation, as the case may
be, before some justice of the peace for the county aforesaid, that
he will well and truly discharge the duties enjoined upon him by 
this act, according to the best of his judgment, without favour, affection
or partiality.
Constable to be
appointed
    10.  AND BE IT ENACTED, That the levy court, at the time of
appointing constables for the county aforesaid, shall appoint a constable
and for the said town, who shall have the same power and
authority that constables in the different hundreds have.

                                   CHAP. LXXVII.
An Act to repeal an act, * entitled, An act to lay out several Turnpike
    Roads in Baltimore County, and the several supplements thereto,
    and for other purposes.

Preamble.     WHEREAS the several turnpike roads in Baltimore county have
been surveyed, laid out, marked and bounded, according to the
provisions of the act, entitled, An act to lay out several turnpike
roads in Baltimore county, and the several supplements thereto:
And whereas the same are opened and supported at a very
great and expensive charge tot eh said county, and the provisions
of the executive part of the several laws relative to said turnpike
roads are not sufficiently guarded, and the said expenses and
charges under proper regulations may be very considerably decreased,
and the said roads may be kept in better repair; therefore,
Supervisor to be
appointed--to
give bond--oath.
    2.  BE IT ENACTED, by the General Assembly of Maryland, That
the justices of the levy court of Baltimore county shall meet at the
court-house of said county on the second Monday in February
next after the passage of this act, and shall proceed to appoint a
fit and proper person as supervisor of the turnpike roads in Baltimore
county, who shall, before he acts as such, give bond to the
state of Maryland in the penalty of five thousand dollars, with
such security as the justices of the levy court shall approve, conditioned
for the faithful performance of all the duties required of
him by this act; and the said supervisor shall, before he acts as
such, take the following oath, or affirmation, before some one justice
of the levy court, to wit:  " I, A. B. do affirm, or make oath on
" the Holy Evangely of Almighty God, that I will well, truly and
" faithfully, discharge the duties as supervisor of the turnpike
" roads of Baltimore county to the best of my skill and judgment;
" so help me God."
To settle accounts

    3.  AND BE IT ENACTED, That the said supervisor appointed in
virtue of this act, shall, on the first Tuesday of October next, and
on the same day annually thereafter, settle his account, on oath or
affirmation, with the said levy court, wherein shall be stated a full
account of all the monies received and all monies expended by him
in virtue of his office, and an account of all the particular articles
