                                LAWS OF MARYLAND.

said road through his, her, or their lands, shall thereupon proceed
to assess and value the damages accordingly, of which the said
commissioners shall have at least five days previous notice, and such
inquisition shall be final and conclusive; Provided always, that the
said road shall not pass through any house, yard, garden or orchard,
without the consent of the owner or owners thereof.

                                      CHAP. CXXXIII.
An Act for the payment of the Journal of Accounts.  Lib. TH. No.
                                            5, fol. 393.
Preamble.     WHEREAS it appears by the journal of accounts of this session,
that there is due from this state the sum of thirty-six thousand
and thirty dollars forty-five and one third cents; therefore,
Treasurer authorised
to pay.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
the treasurer of the western shore shall, and he is hereby authorised
and required, to pay the several persons, their executors, administrators,
assigns or order, or to such of them as shall offer to
receive the same, the several sums of current money allowed to
them respectively, as they may appear to be settled and ascertained
by the said journal of accounts, out of any money now in the treasury,
or that shall come into the treasury, subject to the appropriation
of the general assembly.

An Act to appoint Thomas B. Tubman, of Charles County, Trustee
    for the Sale of certain Land therein mentioned (a).  Lib. TH. No.

                                        CHAP. CXXXV.
An Act to Incorporate a Company to make a Turnpike Road from the
    contemplated Bridge over the River Susquehanna, at Conowingo
    Creek, to the Pennsylvania line.  Lib. TH. No. 5, fol. 395.

a road.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
a company shall be incorporated to make a turnpike road from the
contemplated bridge over the river Susquehanna, at Conowingo
creek, to the Pennsylvania line, in a direction towards New London
Cross Roads.
Subscription
books to be opened.
    2.  AND BE IT ENACTED, That subscription books shall be opened
on or before the first day of May next, at Belle-Air, in Harford
county, at Bald Friar, and at the Rising Sun, in Cecil county, and
at Oxford, in Chester county, Pennsylvania, for a capital stock
for said company of twenty-four thousand dollars, in shares of twenty
dollars each, under the direction of the following commissioners,
to wit:  At Belle-Air by John Forwood, Thomas A. Hays, and Samuel
Bradford; at Bald Friar Ferry, by Jacob Job, Jacob Conrad,
and James L. Porter; at the Rising Sun, by George W. Lightner,
William Preston, and Joseph Moore; and at Oxford, by James
Jackson, Aaron Quinby, David Dickey, and Phineas Ash; who,
or a majority of them, in either district, shall meet at such time as
they shall appoint, they giving thirty days previous notice in the
Baltimore, Lancaster, and West Chester newspapers, and if the
subscription shall exceed the capital, the commissioners shall apportion
