                                LAWS OF MARYLAND.

                                         CHAP. CCXV.
A Supplement to the act*, entitled, An act to prevent Trespasses in
                    Allegany County.

Preamble.     WHEREAS it hath been represented to this general assembly, that
divers persons, not citizens of this state, are in the habit of bringing
large numbers of horses, cattle and hogs, in the upper part of
Allegany county, and there leaving from them to graze and run at large
during the summer season, to the great injury of the citizens; and
it being the duty of the state to protect its citizens, therefore,

as trespassing.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
from and after the first day of March next, if any person not a citizen
of this state, shall drive, or cause to be driven, any horses,
black cattle or hogs, into Allegany county, contrary to the provisions
of the act to which this is a supplement, and suffer them to remain
and run at large, and such horses, black cattle or hogs, shall
be found trespassing on the land of any person or persons, it shall
be the duty of any justice of the peace for said county, on application
of the person or persons so aggrieved, on his, her or their, (as
the case may be,) making oath, that the trespass so complained of
was committed, to issue his warrant to the constable of the hundred
in which such trespass was committed, directing him to sell the
said trespassing horses, black cattle or hogs, at public sale, to the
highest bidder, after giving at least ten days public notice of such
sale, by advertisement set up at the most public places in said hundred,
and the money arising from such sale to be applied as follows,
to wit:  one dollar for each horse, bull, cow, steer, heifer or hog, so
sold, to be paid to the justices of the levy court, to be applied to
repairing the public roads in said county, the constable retaining
for his fee twenty-five cents for each head of horses, black cattle
or hogs, so sold, and shall pay the justice who issued the warrant
twelve and a half cents, and the balance to be paid by the constable
to the owner, when demanded, or it may be lawful for the owner
to redeem the said horses, black cattle or hogs, from the constable,
at any time after such notice being given of his intention to sell as
above mentioned, by paying to the constable the fines, as is directed
by this act.

    2.  AND BE IT ENACTED, That if any citizen of Allegany county
shall keep, or cause to be kept, or herd, or cause to be herded, any
horses, black cattle or hogs, for any person not residing in this
state, and suffer the same to run at large in said county, he shall
forfeit and pay twenty-five cents a head per week for each horse,
bull, cow, steer, heifer or hog, so running at large, to be recovered
before a justice of the peace as small debts are recovered out of
court, and to go to the use of the informer, with costs of suit as in
other cases.
Transfers in certain
cases, to be
null and void.
    3.  AND BE IT ENACTED, That any transfer, except a bona fide
sale of any horses, black cattle or hogs, by persons not residing in
this state, to any citizen of Allegany county, with a view to avoid
the provisions of this act, shall be null and void.
