CHAP. 74.

                                LAWS OF MARYLAND.

called Bentz-Town, bounded on the south by South-street,
and on the east by Bentz-street, continuing said street from its intersection
with South-street northward until it intersects Second-street,
and also including Stephen Stoner's dwelling-house and
tavern stand, to be the first ward; all that part lying east of
Bentz-street, south of Patrick-street, and west of Market-street,
to be the second ward; all that part laying east of Market-street,
and south of Patrick-street, or the turnpike road, running with
the said road so far as will include Michael Buckey's dwelling-house
and tan-yard, and Jacob Buckey's factory, to be the third
ward; all that part lying west of Market-street, south of Second-street,
east of Bentz-street, and north of Patrick-street, to be the
fourth ward; all that part lying east of Market-street, south of 
Second-street, and north of Patrick-street, or the turnpike road,
continuing the said ward eastward so far as to include the stone
and brick-house now occupied by Jacob Buckey, to be the fifth
ward; all that part lying north of Second-street, west of Market-street,
and south of Sixth-street, and also including all lots fronting
on the west side of Bentz-street, from Second-street to
Fourth-street, to be the sixth ward (a); all that part lying north of 
Second-street, and east of Market-street, continuing said street
northward so far as to include Jacob Lease's dwelling-house and
smith-shop, to be the seventh ward; and that the citizens of each
respective ward, qualified as aforesaid; shall on the last Monday
of February, in the year eighteen hundred and seventeen, and on
the same day in every year for ever thereafter, elect one member
for the common council of the said town; the election to be held
for a member of the common council in each respective ward at
such place as shall be designated by the person authorised to hold
the election.

    (a)   By 1818, ch. 140, all that part of the town of Frederick, lying north of
Second-street and west of Market-street, and including all lots fronting on the
west side of Bentz-street, from Second street to Fourth-street, shall be the sixth
ward.

Qualifications of
mayor, &c.
    7.  AND BE IT ENACTED, That no person shall be mayor of the
said town unless he shall be at the time of his election a citizen of
the United States, above the age of twenty-one years, a freeholder
in the said town, within the taxable limits thereof, actually residing
therein, and having resided therein for three years next preceding
his election; no person shall be an alderman of the said
town, unless he shall be at the time of his election a citizen of the
United States, above the age of twenty-one years, actually taxed
by the laws of the corporation, residing within the taxable limits of
the town, and having resided therein three years next preceding
his election; and no person shall be a member of the common council
unless he shall be at the time of his election a citizen of the
United States, above the age of twenty-one years, a freeholder in
the ward for which he shall be elected, residing therein, and having
resided within the taxable limits of the said town one year next
preceding his election.

    8.  AND BE IT ENACTED, That in case of the death, refusal, disqualification,
resignation, or removal of the mayor out of the taxable
limits of the town, the aldermen, for the time being, shall elect
a mayor for the residue of the term; and in case of the death, refusal,
