LAWS OF MARYLAND.
fifty thousand dollars, in two thousand five hundred shares, at
twenty dollars each, under the direction of the following commissioners,
to wit: At Frederick-town, by Colonel John McPherson,
George Baer, Thomas Shaw, John Hoffman, and Peter Mantz;
at New Town, Trap, by Patrick McGill, James Simmons, junior,
Jacob Fiester and Jesse Matthews; at Peters-Ville, by Doctor
William Hilleary, Grafton Duvall, John Slifer, junior, and Benjamin
West; at John Ecard's tavern, by John Brien, Thomas Boteler,
John Ecard, and Alexander Grim; at Baltimore, by William
Jessop, J. E. Howard, James Labes, Luke Tiernan, Henry Payson,
James L. Hawkins, Andrew Ellicott, Isaac Tyson, George Hoffman,
and Philip E. Thomas, or any one of them, who may adjourn
from day to day, and place to place, until the whole stock shall be
taken. |
Organization of

3. AND BE IT ENACTED, That when one thousand
shares of
said stock shall have been subscribed, the commissioners shall give
twenty days notice of the time and place appointed for the subscribers
to meet and organize said institution, and to choose, by plurality
of votes, by ballot, a president and five managers, (three of
whom shall form a quorum,) a treasurer, and such other officers as
they shall deem necessary, to conduct the affairs of the company
until the first Monday in March thereafter, and until a new election,
and to make such by-laws as they shall deem necessary, and
on the first Monday of March in every year, or within ten days
thereafter, said company shall meet for the same purposes, at such
place as the president and managers shall appoint; and in all elections
by stockholders each share shall be entitled to one vote. |

4. AND BE IT ENACTED, That the stockholders
in said company
shall be and they are hereby created a body politic and corporate,
by the name and style of The Harper's Ferry Turnpike Road
Company, and by the same name shall have perpetual succession,
and all the privileges and franchises incident to a corporation, and
shall be capable of suing and being sued, answering and being answered,
and of enlarging their stock by new subscriptions, if the
same shall be found necessary. |
Payments, how to
be made. |
5. AND BE IT ENACTED, That the sums so subscribed
shall be
paid in the following manner: Two dollars on each share at the
time of subscribing, to the commissioner or commissioners, and
the balance to the president and managers aforesaid, in such sums,
and at such times, as they may appoint, giving one month's public
notice of the payment so required, provided that no instalment
shall exceed one fifth of a share. |

out road—their
oath. |
6. AND BE IT ENACTED, That the president and
managers be
and they are hereby authorised to appoint five commissioners, who,
or a majority of whom agreeing, shall lay out the road from the
Frederick and Baltimore turnpike road, beginning at the west end
of Frederick-town, through New-town, Trap, to Harper's ferry,
on the Potomac river, on as straight a line as the nature of the
country will admit; and after having laid out and marked said
road, they shall make a plot of the same, specifying the courses
and distances, and return it to the clerks of Frederick and Washington
county courts, to be recorded; and the said commissioners,
before they proceed to act, shall take the following oath, or affirmation:
