Provisos.

                                LAWS OF MARYLAND.

every cart or wagon, or other carriage of burthen, the wheels of
which do not in breadth exceed four inches, six cents for every
horse drawing the same; for every cart or wagon the wheels of
which shall exceed in breadth four inches, and shall not exceed
seven inches, three cents for each horse drawing the same; and for
every cart or wagon whose wheels in breadth shall be more than
seven inches and not more than ten inches, or being the breadth of
seven inches roll more than ten inches, two and an half cents for
each horse drawing the same; for every cart or wagon whose
wheels shall be more than ten inches and not exceeding twelve
inches, or being ten inches and shall roll more than fifteen inches,
two cents for every horse drawing the same; and for every cart or
wagon whose wheels are more than twelve inches, two cents for
every horse drawing the same; Provided also, that it shall not be
lawful to set up any toll-gate within one mile of any city, town
or village, through which the said road may pass; Provided also,
that no toll shall be demanded or taken from any person going to
or from public places of worship or funerals, on days appointed
for that purpose; Provided also, that persons living adjacent to
and within three miles of any of said gates, shall not pay more
then two tolls for passing or repassing during twenty-four hours,
and persons living within two miles of any said gates not to
pay for passing and repassing more than one toll in the course
of twenty four hours.

    16.  AND BE IT ENACTED, That the president and managers of
the said road for the time being, shall and may be, and they are
hereby authorised and empowered, to grant, demise, and to farmlet
to any person or persons with whom they can agree, the tolls
and duties which they by this act, or their own by laws, are authorised
to demand and receive in and upon and along said road, at
any such gate or turnpike over and upon the same, or any part of
the same, for any time not exceeding seven years, under such rents,
reservations and conditions, as the said president and managers at
any meeting of the board shall agree upon, which grants and demises
shall have the same construction, force and effect, as other
like grants and demises between private persons have and  receive.

    17.  AND BE IT ENACTED, That for the purpose of ascertaining
the weight that may be drawn along and on the said road in any
cart, wagon, or other carriage of burthen, it shall and may be
lawful for the said president, managers and company, to erect and
establish scales and weights at or near such and so many of the
gates erected or to be erected in pursuance of this act, as may be
by them thought necessary; and where there may seem reasonable
cause to suspect that any cart, wagon, or other carriage of burthen,
carries a greater weight than is by this act allowed, it shall be lawful
for the toll-gatherers, or any persons in their service or employment,
to prevent the same from passing such gate until such
wagon, or other carriage of burthen, shall be drawn into the fixed
or erected scales at or near such gate or turnpike, and the weight
or burthen drawn therein ascertained by weighing, and if the person
or persons having charge of the same shall refuse to drive the
same into any such scales for the purpose aforesaid, the person or
persons so refusing shall forfeit and pay the president, managers
and company, any sum not less than five dollars, nor more than
