and gate keepers, as they shall deem necessary, and to
fix their salaries or wages, and to draw on the treasurer for all
sums of money that may have been deposited with him by the said
company, their agents or servants, which said draft or drafts shall
be signed by the president or chairman, and countersigned by one
of the managers. |

7. AND BE IT ENACTED, That if the said company
shall neglect
to keep the said road in good and perfect repair for the space of
ten days, and information shall be given to any justice of the peace
in the county of Baltimore, such justice shall issue a precept to be
directed to any constable, commanding him to summon three disinterested
freeholders named by said justice in the said precept, to
meet at a certain time in the said precept to be mentioned, at the
place in the said road complained of, of which meeting notice shall
be given to the keeper of the gate nearest thereto, and the said
justice shall at such time and place, on the oaths or affirmations of
the said persons, inquire whether the said road is in such good
order and repair as aforesaid, and shall cause an inquisition to be
made and certified under the hands of himself, and a majority of
the said persons, and if the said road shall be found by the said inquisition
to be out of order and repair contrary to the true intent
and meaning of this act, the said justice shall thereupon certify and
send one copy of said inquisition to the chief judge of Baltimore
county court, who shall thereupon order the gate or gates of said
company to be thrown open and so remain until the said road is
repaired and put in good and perfect order; and during the time
the gates shall remain so opened, it shall not be lawful for the said
company, their agent or toll-gatherer, to ask, demand or receive,
from any person travelling on said road, any toll for passing the
same; and in case any toll-gatherer shall offend against the provisions
herein contained, he shall upon conviction forfeit and pay to
the person injured a sum not exceeding fifty dollars, and not less
than five dollars, with costs, to be recovered before a justice of the
peace in the manner small debts are recovered. |

8. AND BE IT ENACTED, That all wagons and
drivers of carriages
of all kinds, whether of burthen or of pleasure, using the
said road, shall, except when passing by a carriage of slower
draught, keep their horses and carriages on the right side of the
road in the passing direction, leaving the said road free and clear
for other carriages to pass, and if any driver offend against this
provision, he shall forfeit and pay the sum of five dollars to any
person who shall be obstructed in his passage and shall sue for the
same, to be recovered before any justice of the peace in the same
manner that small debts are recovered. |

9. AND BE IT ENACTED, That it shall not be
lawful for the said
company to ask for or receive, of or from any person owning lands
adjoining to said road, any toll for passing the same more than
once in twenty-four hours. |

10. AND BE IT ENACTED, That all sums of money
which shall
or may be collected as tolls under the authority of this act, shall,
after first deducting the expense of collecting the same, be appropriated
in improving and repairing the said road, and in and for
no other purpose whatever. |

11. AND BE IT ENACTED, That it shall and may
be lawful for
the said company at any time hereafter to extend the said turnpike |
