CHAP. 48.

Tolls may be increased.

Proviso.

                                LAWS OF MARYLAND.

    12.  AND BE IT ENACTED, That the president and managers of
said company, may in their discretion increase the tolls beyond
the rates herein prescribed, such not exceeding thirty-three and a
third per cent. during the months of December, January, February
and March; Provided, that for the rest of the year, the tolls
be so much lowered that on making an average of the rates and
time, such average shall not exceed the rates prescribed as aforesaid.

Roads may be
shut up.
    13.  AND BE IT ENACTED, That the justices of the levy courts
of Baltimore and Harford counties respectively, shall have power
to discontinue and shut up any public road which they shall deem
to be rendered unnecessary by reason of opening said road or
roads, if the same shall be desired by the party through whose
land the old road does pass, and whenever by the departure of the
new road from the bed of the old road it may be necessary to extend
any road which at present leads into and intersects the old
road, it shall be lawful for the justices of the levy courts aforesaid
to extend such road until it intersects the new road in such direction
as said justices shall deem most conducive to public utility.
Commissioners'
compensation.
    14.  AND BE IT ENACTED, That said first named commissioners
shall receive two dollars per day for every day they shall be employed
in executing the duties imposed by this act, which with all
other charges which shall be incurred in laying out said roads shall
be paid by said company.
Levy, when to be
made.
    15.  AND BE IT ENACTED, That the levy court of Harford county
shall not levy money for opening either of the roads from Belle-Air
to the Susquehanna river, or to pay any damages for the same,
until the building of a bridge shall be commenced at the termination
thereof, that is to say, at Rock Run or the Rough Island.

                                       CHAP. XLIX.
An Act to lay out a Road in Baltimore County.  Lib. TH. No. 4,
                                            fol. 468.
Commissioners appointed
to lay out
and open a road.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That 
William Matthews, Jesse Hoshell and Joseph Jones, be and they
are hereby appointed commissioners, and they, or a majority of
them, are hereby authorised to lay out and open at the expense of
the petitioners, or any person or persons who may think proper to
contribute thereto, a road not exceeding thirty feet in width, in the
best and straightest direction that the nature of the ground will
admit of, beginning at a county road at or near Jacob Sumbergher's,
from thence to William Hoffman's mill, and from thence
until it intersects the old York road at or near Joseph Jones's, and
the said road, when laid out and and opened, and the valuation herein
after directed to be made shall have taken place, and a plot thereof
made out and returned to the clerk of Baltimore county, to be recorded
among the records of said county, shall for ever thereafter
be deemed a public road, and shall be kept in repair as other public
roads in said county.
Damages to be ascertained.     2.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, shall ascertain and value what damages may be
sustained by any person or persons through whose land the said
road may pass, and the said valuation shall be made, and the damages
paid, or secured to be paid, to the person or persons aggrieved
