CHAP. 5.

                                LAWS OF MARYLAND.

and may be lawful for the levy court of said county to levy upon
the assessable property of said county such sum of money as they
may deem necessary, and to appoint and employ an overseer to
open and clear said road agreeably to the plot and certificate aforesaid,
and the said road, when opened and cleared as aforesaid, shall
be and the same is hereby declared to be for ever thereafter a public
road, and shall be kept in repair as other public roads in said
county.

Damages to be ascertained.     3.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, shall value and ascertain the damages that may be
sustained by each and every of the persons through whose lands the
said road may pass, (petitioners to the general assembly for this
road only excepted,) by opening the same, taking into consideration
the advantages and disadvantages, and return the same to the
levy court, together with the plot and certificate as above directed;
and the damages so ascertained shall be levied and assessed as other
county charges are, and shall be paid over to the persons respectively
who may be endamaged thereby; Provided nevertheless, that
no money shall be levied or assessed for the purpose of paying the
damages aforesaid, until the said road is opened and cleared agreeably
to the directions of this act.
Commissioners'
compensation.
    4.  AND BE IT ENACTED, That the said commissioners shall be
entitled to receive as a compensation for their services a sum not
exceeding two dollars per day, to be ascertained by the levy court,
which is hereby directed to be levied, collected and paid, as other
county charges.

An Act authorising a Lottery to raise a sum of money for the purpose
    of building a School House in the Vicinity of Taney-Town, in Frederick
    County.

Lottery authorised
—bond to be given.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
it shall and may be lawful for the Reverend John Grub, David Kephart,
Henry Rinedoller and Peter Haun, or a majority of them, to
propose a scheme or schemes of a lottery for raising a sum of money
not exceeding one thousand dollars clear of all expenses, and
sell and dispose of the tickets in said lottery and to draw the same;
provided, that the said John Grub, David Kephart, Henry Rinedoller
and Peter Haun, or a majority of them that undertake to act under
this law, shall, before the sale or disposal of any ticket or tickets
in said lottery, give their bond to the state of Maryland, in the penalty
of double the sum raised, conditioned that they will well and
truly apply so much money arising therefrom, within three months
after the drawing of said lottery shall be completed, as will satisfy
the fortunate adventurers for prizes drawn by them, and after deducting
the necessary expenses incurred in said lottery, shall within
twelve months after the drawing of said lottery shall be completed,
apply the money arising by such lottery for the purpose of
building a school house, wherein the German and English languages
may be taught.
Bond to be lodged
in clerk's office.
    2.  AND BE IT ENACTED, That before the above named John
Grub, David Kephart, Henry Rinedoller and Peter Haun, or a majority
of them, shall proceed to act, their said bond shall be lodged
in the office of the clerk of Frederick county, to be there recorded;
