now located from Richard Owing's mill to the church aforesaid
will pass, that said road is crooked and may be straightened with
much less injury to private property than now exists; therefore, |

1. BE IT ENACTED, by the General Assembly
of Maryland, That
Richard G. Stockett, Gustavus Warfield, Charles Sterrett Ridgely,
Larkin Dorsey, of Caleb, and Gassaway Watkins, or a majority
of them, be and they are hereby appointed commissioners to inquire
into and ascertain whether or not a public road is required
for public convenience from Richard Owing's mill to Elk Ridge
Church in Queen Caroline Parish. |
If required to locate
the same. |
2. AND BE IT ENACTED, That if the commissioners
aforesaid,
or a majority of them, shall be of opinion that public convenience
require the road aforesaid, they, or a majority of them, shall proceed
to locate the same, taking into consideration the ground over
which it shall pass, the convenience of the public, and the interest
of those whose lands the road will go over, and return a plot
thereof to the clerk of Anne-Arundel county court, who is hereby
directed to file the same, with the plots of other public roads in
the county. |
To ascertain damages. |
3. AND BE IT ENACTED, That the commissioners
aforesaid, or
a majority of them, shall also from the testimony offered, as well
as from their own opinions, ascertain the damages that individuals
would sustain by the opening of the road as aforesaid, to the owners
of land through which it may pass, and upon such damages being
assessed and paid, or tendered to the person or persons entitled to
receive the same, the commissioners aforesaid, or a majority of
them, shall proceed to open the road of the width of thirty feet,
and it shall thereafter for ever be taken and considered as a public
road. |

4. AND BE IT ENACTED, That an act, entitled,
An act to lay
out and open the road from Richard Owing's mill to Elk-Ridge
Church in Queen Caroline Parish, in Anne-Arundel county,
and the supplements thereto, passed at November session eighteen
hundred and eleven*, be and they are hereby repealed. |

An Act to alter and change the place of holding the Elections in
the
First Election District of Kent County. Lib.

Judges to appoint
place of election. |
1. BE IT ENACTED, by the General Assembly
of Maryland, That
the judges of the first election district of Kent county be and are
hereby authorised and directed, to hold in future the elections in
said district at such place as may appear to them most convenient. |
To return a certificate
of place fixed
on to clerk of
county. |
2. AND BE IT ENACTED, That where the judges
aforesaid shall
have made choice of a fit and proper place for holding said
election, agreeably to the directions of this act, and shall have
returned a certificate thereof, under their hands and seals, to the
clerk of the county court, to be recorded, the same shall be the
place of holding the elections for the first district of Kent county,
any law to the contrary notwithstanding. |
Return to be made
before first June
next. |
3. AND Be IT ENACTED, That a return of said
certificate shall
be made on or before the first day of June next, and the clerk
aforesaid shall record the same among the records of Kent county. |
