CHAP. 58.








Proviso.

                                LAWS OF MARYLAND.

thence to the Delaware line through the lands of John R. Evans,
John Ginn, William Wilson and Elizabeth Passmore, at or near
a place where is located in Delaware a road from Newark to the
Maryland line, ending on the land of the said Elizabeth Passmore;
and that they, or a majority of them, lay the road on the said private
road from the said Howard's store, as nearly as may be by
them, or a majority of them, deemed advantageous to the public
convenience, and the least possible damage to individuals; Provided
always,
that the said road shall not pass through the buildings,
gardens or orchards, of any person or persons, without the consent
of the owner or owners.

Plot to be made
and recorded.   Levy
authorised.
    2.  AND BE IT ENACTED, That it shall be the duty of the commissioners
aforesaid to cause a plot and certificate of said road to
be made, and return the same to the levy court of Cecil county,
whereupon it shall and may be lawful for the levy court of said
county to levy upon the assessable property of the said county a sum
of money such as they may deem necessary, and to appoint an overseer
to open and clear said road agreeably to the plot and certificate
aforesaid; and the said road, when opened and cleared as aforesaid,
shall be, and the same is hereby declared to be, for ever thereafter,
a public road, and shall be kept in repair as other public roads in
said county.
Damages to be ascertained.








Proviso.
    3.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, shall value and ascertain the damages that may be
sustained by each and every of the persons through whose lands
the said road may pass by opening the same, taking into estimation
the advantages and disadvantages, if any, and the damages so ascertained
shall be levied and assessed as other county charges are,
and shall be paid over to the persons respectively through whose
lands the said road may pass; Provided, that no person or persons
shall be entitled to receive damages for any injury they may sustain
by widening the aforesaid old road.
Commissioners'
compensation.
    4.  AND BE IT ENACTED, That the said commissioners shall be
entitled to receive a compensation for their attendance and services,
in discharge of their duties under this act, not exceeding two dollars
per day, to be ascertained by the levy court, which is hereby
directed to be levied, collected and paid, as other county charges are.

An Act for the relief of Anne and Mary Cheswick, Daughters of Anne
        Strong, of Saint-Mary's County.

Levy authorised 
for their support.
    BE IT ENACTED, by the General Assembly of Maryland, That 
the justices of the levy court of Saint-Mary's county shall and they
are hereby empowered at their levy court annually, so long as they
shall see cause, to assess and levy on the assessable property of said
county, a sum of money not exceeding sixty dollars, for the support
and maintenance of the said Anne and Mary Cheswick, daughter
of the said Anne Strong, and that the same be collected annually
by the collector of Saint-Mary's county, and by him paid to the
said Anne Strong, or her order.
