CHAP. 28.

Road vacated.

                                LAWS OF MARYLAND.

    1.  BE IT ENACTED, by the General Assembly of Maryland, That
a road beginning at Otho Trundle's, on Carroll's manor, which
crosses the Monocacy at Davis's ford, and running through the
farms of the said Davis and Dawson, to where it intersects the
public road opposite John T. Veatche's, living on the farm of Levin
Luckett at the mouth of Monocacy, shall be and the same is hereby
vacated, and no longer considered as a public road and highway.

An Act to lay out and straighten a Road in Baltimore County.  Lib.

Preamble.     WHEREAS it is represented to this general assembly by the petition
of Francis Holland, that he, the said Francis Holland, together
with a certain James Croxall, obtained a law for the opening
and straightening a road from Annapolis to Baltimore; that the
said Francis Holland has fully complied with the provisions of the
said act, at no small expense, by having the road opened, made
and straightened, so far as it runs through Anne-Arundel county;
that the said James Croxall neglected to comply with the said act,
and is since dead, and that that part of the said road which runs
through Baltimore county has never been opened, made and straightened,
as contemplated by the said act, in consequence of which the
said Francis Holland suffers great injury; therefore,
Commissioners appointed
to straighten
and amend a
road.
    1.  BE IT ENACTED, by the General Assembly of Maryland, That
William Baker, Charles Bohn, junior, William Ashman, Peter
Forney and Daniel Hoffman, be and they are hereby appointed
commissioners to straighten and amend the road now opened and used,
from James Croxall's point, on the river Patapsco, until it intersects
the George-town road at or near Mrs. Carroll's bridge, on
Gwinn's Falls, in Baltimore county, of a width not exceeding thirty
feet; and the said road, when so straightened and amended, and
the valuation herein after directed to be made shall have taken place,
shall be recorded by the clerk of Baltimore county, and shall for
ever thereafter be deemed and taken to be a public highway, and
kept in repair as other public roads in said county.
To ascertain damages
sustained.
    2.  AND BE IT ENACTED, That the said commissioners, or a majority
of them, shall ascertain and value what damages may be
sustained by any person or persons through whose lands the said
road shall pass, taking into consideration the advantages and disadvantages,
(if any,) and the same when so assessed shall be paid,
or secured to be paid, by the said Francis Holland, to the person
or persons entitled to receive the same, within six months after the
said damages shall be ascertained in the mode prescribed by this
act.
Persons aggrieved
by such ascertainment
may have
jury summoned.
    3.  AND BE IT ENACTED, That of any person or persons through
whose lands the said roads shall pass, or his, her or their guardian
or trustee, shall conceive himself, herself or themselves, aggrieved
by such valuation and assessment of damages by the said commissioners
respectively, it shall and may be lawful for any justice of
the peace, on his, her or their application, to issue his warrant, under
