CHAP. XI.
An Act to authorise the Justices of the Orphans Court of Montgomery
County, to cause the Records of said Court to be transcribed.

Preamble. |
WHEREAS it is represented to this general assembly,
that some
of the records of the orphans court of Montgomery county are in a
ruinous situation; and as it is necessary that the said records should
be kept safe and secured, therefore, |

1. BE IT ENACTED, by the General Assembly
of Maryland, That
the justices of the orphans court of Montgomery county, be and
they are hereby authorised and empowered, to employ a suitable
person to transcribe into a well bound book or books, with
an alphabet, all such records and papers, and all such parts of the
minutes and proceedings, as the said justices shall deem necessary,
in a plain, legible hand writing. |

2. AND BE IT ENACTED, That before the person
so employed
shall proceed to copy the said records, he shall take the following
oath or affirmation before some person authorised to administer the
same: " I, A. B., do solemnly swear or affirm, (as the case may
be,) that I will make a true transcript from the records, papers
and minutes, which I am directed to copy by the justices of the orphans
court of Montgomery county, without mutilation or alteration;
so help me God." |
Expenses to be levied
on county. |
3. AND BE IT ENACTED, That the person employed
as aforesaid,
shall be allowed for his serviced aforesaid, the sum of ten cents for
each and every side which he shall copy; which said sums, as well
as the costs of the books aforesaid, shall be levied on the assessable
property of Montgomery county aforesaid, and collected in the
same manner as other county charges are levied and collected, and
when levied and collected, the justices of the orphans court of
Montgomery county are hereby directed to pay the same to the
person employed by them for the purpose aforesaid, or to his order. |

CHAP. XII.
An Act authorising the Levy Court of Washington County to appoint
Commissioners to lay off the Road therein mentioned.

commissioners
to lay off a
road. |
1. BE IT ENACTED, by the General Assembly
of Maryland, That
the levy court of Washington county be, and they are hereby authorised
and directed, to appoint three commissioners, and they or a
majority of them, are hereby authorised to survey and lay off a
road, (provided they, after having viewed and surveyed the grounds,
and considered its utility, shall deem it expedient) not exceeding
thirty (a) feet wide, from Henry Snider's mill, in the most direct
and practicable route, to intersect the turnpike road at a convenient
point, between the foot of the mountain and the town of Boonsborough,
so as the same shall not be laid out over any orchard,
garden, yard or meadow, of any person, without the consent of the
owners, and when surveyed and laid out, to return a plot thereof to
the clerk's office of said county, to be there filed and recorded.
