June 10th. 1691 ( 98 ) - - - - - - - - - To all Christian people to whom this present writing shall come we Michael Clugstone and Richard Chambers of the County of Somerset and Province of Maryland Send greeting &c. whereas divers Controversies and debates heretofore have been made, had and are now depending. Between Richard: ffarewell Attorney of mr John Loader of New England Merchant, on the one part, and Walter: Lodge Chyrurgeon on the other part, and for the appeasing and determining whereof the said parties have Submitted themselves and are become bound each to other in the penall Sum of twenty thousand pounds of good sound Merchantable tobacco as by their severall Obligations bearing date the fifth day of June 1691. it doth and may appear with Condition for the true performance of all and every the Award Arbitrament, determination & judgmt of us the above said Michael. Clugston and Richard Chambers, Arbitrators indifferently chosen and elected as well on the part of the said Walter Lodge, as on the part of the said Richard ffarewell, to Award Arbitrate Judge and determine of and concerning all and all manner of actions, Suits, judgments, accots, reckonings trespasses, strifes, variances, debates, quarels, Controversies and demands whatsoever, had made moved or are yet depending between the said Walter Lodge and Richard ffarewell. from the begining of the world to the day of the date of these presents, alwayes provided that the said Award of us the abovesd Arbitrtors be put in writing under our hands and Seals, and a true Coppie thereof delivered to each of the said parties at or before the 11th. day of June 1691: As by their Several Obligations with their Conditions fully appeareth Now know ye that we the said Michael: Clugston and Richard Chambers Arbitrators as aforesd taking upon us the Charge of the said Award and Arbitrament having heard the Allegations and sayings, and exactly viewed the papers, examined the witnesses of either parties, concerning the premises, and minding to Sett unity and friendshipp between them concerning the same, do therefore put in writing this our Award, Arbitramt determn and judgmment in manner and forme following. That is to say first we do Award, Arbitrate determine and judge by these presents. Walter: Lodge or his Execcuters to pay or cause to be paid to Richard ffarewell or his Execcutors. the full and just Sum of Six thousand eight hundred fourty four pounds of tobacco and that y Said Richard: ffarewell.for himself and Execcutors shall deliver as his deed to the said Walter: Lodge or his aforesaids for his use a Release and discharge from all and all manner of Suit or Suites, between them had or made from the begining of the world to the day of the date of the said discharge. In wittness - whereof we have hereunto sett our hands and seals this fifth day of June. 1691. - - - - - - - - - - - - we also Award that the said Walter Michael: Clugston. ? Sealed Lodge pay Cost of Suit. - - - - - - - Richard Chambers. ? Sealed Somerset County Ssc. The humble petion of Elinor Ennit to their Mates Justices of the Peace for Somerset County, sheweth yt whereas your Petioner is a widdow woman and hath five Children and is not of ability to keep them humbly desire your worps that you would be pleased for to lett your Petitioner bind two of her Children to Anthony Bell. One called by the name of Edmund Ennit, for the full time of Sixteen years from the 15th. of July next, also Anne. Ennit, till she shall come to the age of Sixteen years of age, which Children your Petitioner humbly craves may be made over to the sd Anthony Bell by your worps, to the sd Anthony Bell, and your Petioner as in duty bound shall ever pray: ------- which petion was granted and both the abovesd Children in Open Court were made over to the said Anthony Bell. according to petion, the boy adjudged, his age as in petion; the girl adjudged to be th(irteen) years old the 11th. of April last past, according to her Mothers description. The sd Anthony did promise in Court to end(eavor) to learn the boy to read, and at twelve years of age, to give the sd boy a yearling Heifer, which was to be kept by the sd Anthony with its increase both Male and female for the sd boyes use. |
