June 9th: 1691` ( 86 ) This day Majr Ambrose London was by Order of Court Comitted into the Sheriffs Custody for abuse Offered to sd Court, and was Ordered there to remain till Security given for his good behaviour Order that William: Denson. John: Starling and William Bozman be fined for not tending on the Orphants Jury of Enquiry when called being legally Sumoned, unless they shew cause to y Contrary Their. Maties Somerset County Ssc. The Jurors for their Maties being Sworne upon agt the holy Evangelists at a Grand Jury held for the body of this John: Kemp County the second tuesday in 9ber last past do present and find that Jno - - - - - - - - Kemp of this County Planter is of evil fame, and by the Inhabitants of this County espetially the viconage where he the sd Kemp liveth Suspected, togeather with Robert Down upon the two and twentieth day of July 1690 without any Comission from the authority of this Province, did range the woods and take up one horse Colt belonging to Capt: Jno: Winder Gent, and then did brand the sd Cold without the knowledge Consent and privity of the sd Winder Contrary to the Law, as also to the great loss and damage not only of the sd Winder but also of all the good people of this Province and against the publick peace, unto which peace the sd John. Kemp was by recognizance bound in June Court 1689. Yett Notwithstanding of the aforesd prumuire? the abovesd premises hath comitted there fore there Maties Attorney Craves judgment may be entered agt the sd Kemp according to law in that Case made & provided. &c. Ja. Sangster. Clk. Indts Declaration being read to which the sd Kemp pleaded not guilty and for tryall put himself upon the Country whereupon Comand was given to the Sheriffe to Sumon twelve good and lawfull men of his vicenage that the matter might be the better known; whose names are as followeth viz Peter:Elzey. John: Smock Wm: Henderson Wm: Benson. Thomas: Horseman. Wm:Noble. Miles: Gray. Edward:Evins Wm: Hearne. Henry Hudson Senior. Bryan: Peart. Thomas Tull. who being duely returned, impannelled and Sworn in Court who having heard the aforesd Indictmt. read, as also the Oaths of eight evidences receives their Charge and are Sent forth to determine the same. Evidences sworn on And being returned in Court being called over perticuliarly by their their Maties behalf } names, being unanimously agreed do return this following verdict Thomas: Gordan Rich: Ackworth viz. we of the Jury findeth the defendt. guilty of the Indictment Thomas:Ackworth --------Ackworth? Peter:Elzey foreman John: Richins Thomas:Wilson verdict was Edward. Wright. Wm. Giles Junr. which ^ Ordered to be entered - - - - - - - - - Jno: Rickards, Junr After which verdict was entered it was the judgmt of this Court that the sd Kemp pay halfe to Capt.Jno: Winder four fold for the Colt which colt was valued at five hundred pound of tobacco^ and that the sd Kemp give good Security for his good behaviour and Court Charges. whereupon came the sd Kemp with his two Securities John: Hamlin and Manasses Morris, and the sd Kemp by Recognizance did acknowledge himself to be indebted to their Maties in the sum of 10lb:Sterling the sd Hamlin & Morris in the Sum of five pound sterling money a peice to be leavied on their goods and Chattels Lands and Tenements for their Maties uses &c. The Condition of which Recognizance is Such, that if the above bound Jno: Kemp be of the good behaviour |
