( 75 ) March 11th. 1690/1 Declaration and Plea being read in Court, the matter was sometime debated, but not fully determined the result where of was (viz) that it should be Continued; giving Security to abide the award of mr. Clugston and Richard Chambers. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - Vide two Depositions, mentioned in folio 73. ) Somerset County in Maryland Ss. The Deposition of Elinor Harris Aged Seaventy five years or thereabouts who being duly examined & Sworne on the Holy Evangelist, saith, that some Small time after the death mr Josias Seaward; Walter Lane came to the late dwelling house Plantation of the said Seaward, and togeather with George Seaward did make a firm Bargain and agreement with William Woodland about living upon the said Plantation and in the said house, the said Woodland being to have One half of what was made on the said Plantation, also the whole benifit of the milk of Six Cows, and the whole benifit of the Orchard, the said Wm: Woodland being to live and enjoy the Said land and premises dureing the pleasure of the said Lane, or till he should turne them off, and farther this deponant saith that the said Walter Lane in the presence and with the Consent of George Seaward did take two Nigroes belonging to the Estate of Josias Seaward Named Casar & Boston by the hands and did deliver them to William Woodland to be with him as a Confirmation of the Agreement between them, but William Woodlands wife not being satisfied therewith advised her Husband to take from under the hands of Walter Lane and George:Seaward, that they might be assured how long they should enjoy the said Land and Nigroes &c. and thereupon she spoke to mr Lane her self and desired that the agreement might be in black and white. Walter Lane then made answer, the times were unsetled and troublesom that he could not draw Conditions then; but called his Brother John: Lane to wittness what was done. This Deponant saith that George Seaward gave his assent to all that was done. Likewise William: Woodland being somewhat dissatisfied, that he was to have but half of what was made, mr Lane made answer that he would make it up to him Otherwise (or words to that effect) this deponant further saith, that the said Walter: Lane did take into his posession and Carryed away from y sd Plantation one Boat Some tarr, and some ring bolts the quantity uncertain of the propper Estate of Josias Seaward deceased and farther saith not her Elinor Harris marke. Examined and sworne before us underwritten this 29th: day of December: 1690 Edmund: Howard Thomas: Newbold Somerset County in Maryland Ss. The Deposition of Ann: Woodland Aged fourty One years or thereabouts, who being duely Examined & sworne on the holy Evangelist, saith that some small time after the death of mr Josias Seaward. Walter: Lane Came to the house late dwelling house of the said Seaward, and togeather with George Seaward, did make a firm bargain and agreement with her Husband William Woodland about living upon the said Plantation & in the said house, the said Woodland being to have the one half of what was made on the Plantation, also the whole benifitt of the milke of six Cows, and the whole benifitt of the Orchard. verte |
