( 51 ) ffebruary 12th. 1690/1 appeareth by the defts Bill here in Court produced, and the same Bill & Sum Ordered by the sd Webb to the plt was assumed and faithfully promised to be paid to the plt by the said deft upon receit of the sd Bill, yet Notwith standing of the defts promise and assumption the deft fraudulently and Craftily intends to deceive the plt of the aforesd Sum of 800lb. of tobacco. The payment of the same hath hitherto denyed, and yet doth deny to the plts great losse and damage to the value of Sixteen hundred pounds of like tobacco, and hereupon brings this suit Sangster pr Quer pl prse. Jno. Doe Rich: Roe. The defendt pleads Satisfaction. puts himself upon the Court Dent. This Bill bindeth me John:Rickards of Somerset County in the Province of Maryland Joyner my Heirs Execcutors and Administrators to pay or cause to be paid unto John: Webb of Somerset County Innholder his Heirs Execcuters Admrs Admrs. or Assigns the full and just Sum of Eight hundred pounds of good sound Mertable leaf tobacco and Caske Convenient at Some Town in the aforesd County at or upon the tenth day of October next ensueing the date hereof as wittness my hand and seal this twentieth day of June Anno. Randall Revell made Oath to the Assumtion of Rickards This Court grants Order for 800lb tobacco according to Declaracon Jacob: Preen Plt. Somerset County Ss. Robert Houlston of this County was attached agt to answer unto Jacob: Preen, of a Plea of trespass upon ye Case. &c. Robert:Houlston Deft And whereupon the said Jacob by Peter Dent his Attorney Complaineth - - - - - - - - - - - that whereas the said Robert the 14th. day of October in the year of our Lord 1689. at Pocomoke within the Jurisdiction of this Court was indebted to the said Jacob in the sum of nine hundred ninety one pounds of Porke being for Sundry goods and Merchandizes Sold and delivered as by a perticular accot. thereof here in Court produced may appeare, and the said Robert to the said Jacob in manner aforesd being indebted did assume upon himself, and to the said Jacob faithfully promise that he the said Robert the said Sum of 991. Pounds of Porke, when he should be thereunto requested would well and truly content and pay. Nevertheless the said Robert his promise and assumption aforesd not regarding but minding and fraudulently intending him the sd Jacob in this behalfe craftily and Subtily to deceive and defraud the said Sum to the said Jacob hath not paid, but hath hitherto refused and doth still refuse to the damage of the sd Jacob of 1600 Pounds of tobacco and thereupon he bringeth his Suit &c. Issue joynd. the matter was left to Dent Pleg &c. Jno. Doe the judgmt of this Court Rich: Roe The Defendt pleads Satisfaction. Ja: Sangster. Octobr ye 14th. 1689.
