9ber. 14. 1690 ( 2 ) This Court Orders ffrancis Thorrowgood to be fined for being drunk and abuseing the Justices according as the law provides in Such cases and further Orders that he the said Thorrowgood give good Security for his behavious dureing the Courts pleasure. - - - - And whereupon came the said ffrancis Thorrowgood, and in Open Court did per recognizance acknowledge him selfe to be indebted to their Maties in the sum of One hundred pounds sterling money of England to be leavyed upon his goods chattels and Tenements Likewise came ye said Thorrowgoods securities and did confess themselves to be indebted in the sum of fifty pounds of like money viz Peter: Dent Attorney at law. and Robert Houlston due to be leavied as abovsd for their Maties. uses &c. with fines and fees. &c. - - - - - - - - - - - - - The Condition of which Recognizance is Such that if the above bound ffrancis Thorrowgood be of the good behaviour and abrearance to all their Maties Leige People of this Province (but more espetially to their Maties Justices of the Peace of this County) dureing pleasure. as also pay Court charges then this Recognizance to be void other wayes to be and remain in full power force and vertue - - - - - Samuel: Tomlinson Plt. Somerset County Ssc. / John: Carter of this County Planter was agt: Sumoned to answer unto Samll. Tomlinson of the same County John: Carter Deft in an action upon the Case. And whereupon the plt by Jame - - - - - - - - - Sangster his Attorney. Comes and sayes, that the deft is and stands indebted unto the plt in the full and just sum of seven Thousand six hundred and ninety pounds of good sound Mertable tobacco in Consideration of Severall goods and Chattels by the deft had, as will more fully and plainly appear by accot. and here in Court produced, which said sum the plt hath demanded of the deft. but he the said deft. fraudulently and craftily intending to deceive the plt hath denyed to pay and yet doth deny to the plts great losse and damage to the value of fifteen thousand three hundred pounds of tobacco, and here upon brings this suit &c. And the deft by Peter Dent his Attorney defends the force and injury , and saith that ye plt is indebted to the defendt in a debt of a higher nature, and this he prayes may be enquired of by the Country.
