8ber primo. 1691 ( 172 ) - - - - - - - - - The aforeds Declaration and precept being Read, it was Considered and adjudged, that the sd action brought agt mr Thomas Newbold and mr Samuel: Hopkins two of the Justices of the same Court, was not in the power of this Court to try the action. - - - - - - - - - - - - - - - - - - - - - - - - - - Evid.sumd Whereupon the said John Tayler Craved an appeal, which by the Court was granted Jno.Starrett & giving Such Security as the sd Court should approve on. - - - - - - - - - - Antho. Belle The next day the sd Tayler humbly craved that the appeal before granted C - - - might be reversed, which likewise was granted. - - - - - - - - - - - - Mr. Alexander McSwaine. Plt: Somerset County Ss. William: Morris late of this County was Contra. attached to answer unto Alexander Mc.Swaine of a Plea of William: Morris. Defendant trespass on the Case &c. And whereupon the sd Alexander by Peter Dent his Attorney, Complaineth that whereas the said William the 11th: day of December in the year of our Lord 1690. at Pocomoke within the Jurisdiction of this Court was indebted to the said Alexander: McSwaine in the Sum of One hundred ninety and six pounds Of porke as by account thereof here in Court produced may appear, and the William to the sd Alexander in manner aforesd being indebted did assume upon himself and to the sd Alexander in manner aforesd being indebted faithfully promise that he the said Wm. the sd Sum of One hundred ninety Six pound of Porke to the sd Alexander when requested would well and truly Content and pay Nevertheless the sd William his promise & assumption aforesd not regarding but minding and fraudulently intending him the sd Alexander in this behalfe to deceive and defraud the sd Sum of 196. Pounds of Porke hath not Paid but hath hitherto refused and doth still refuse to the damage of the sd Alexander of 800: Pounds of Porke and thereof brings his Suit. Dent pr Quere. Plegs. &c. Jno.
