The sd Chambers & Lane both appearing, & pleading to their Petion. The Court demanded what Estate there was of the sd deceased and in which posession. The abovesd accot proved in Open Court by ye Oath of mr James: Round. mr ffrancis: Jenckins Admr to sd Cooper Confesseth judgmt to ye abovesd Ballance if assetts in his hand This Bindeth me Samuel: Cooper of Somerset County in the Province of Maryland Innholder my Heirs Execcutors and Admrs to pay or cause to be paid unto George Banam. of the Same County Cooper, his Heirs, Execcutors Admrs or Assigns the full & just Sum of twelve hundred & fourty pounds of good Sound Merchantable leaf tobacco & Caske Convenient at Some place in the sd County at or upon the 10th. day of November Ensueing the date hereof as wittness my hand and Seal this 9 th day of August 1687. Petioner the Sum of eight hundred thirty Seven pounds of tobacco & Caske wch debt was proved at yr Court in November last past and the Bills remaining in the Clerks Office, for which debt a Caveat was entered, no Admr then appearing. Now for as much as mr Walter Lane hath taken out letters of Admrn.on sd Sewards Estate yr petioner prayeth yt he may have judgmt.agt the sd Estate in ye sd Lanes Custody for his foresd debt 837lb.tobacco & Caske wth Costs & he will pray / upon wch Petion.mr Lane required a litle time to overhall his papers. which pr Court was granted. / |
