( 135 ) June ye 13 yj 1691 - - - - - - - - - - The said Edmund in his good name fame reputation and honest conversation aforesd, greatly to hurt and make worse, and to bring him the sd Edmund undeservedly under the laws of England and this Province touching Roguery and theft. upon the 14: day of December in the year of our Lord 1690. at Pocomoke within the Jurisdiction of this Court having comunication of and concerning him the sd Edmund with Severall of the good people of this Province then and there present, these false feigned, Scandalous and malitious words following did Say relate and publish. (that is to say) that he the sd Edmund meaning was a Rogue, and that he the sd John would prove it, by means of which word the sd Edmund Saith that he is hurt and made worse in his good name and Credit to the value of 5000. Pounds of tobacco and thereof brings his Suite &c. Jno. Doe Dent. Pleg. Rich: Roe Bail Bond Ordered to be Assigned pr Court. Mr. James: Round Plt. Somerset County Ss. Henry:Lynch Mercht. was attached to answer unto James Contra . Round Gent. of a plea of trespass on the Case &c. Henry: Lynch Mercht Dft. And whereupon the sd James by Peter: Dent his Attorney Complaineth yt - - - - - - - - - - - - whereas the said Henry Sometime in the year of our Lord 1689. at Monocan within the Jurisdiction of this Court was indebted to the sd James in the Sum of nine hundred twenty Six pounds of tobacco being for So much due by the sd Henry to the sd James for the ballance of a Certain account as by the said account here in Court Produced may appear, and the sd Henry to the sd James in manner aforesd being indebted did assume upon himself and to the sd James faithfully promise, that he the sd Henry the sd Sum of tobacco when he should be thereunto requested would well and truly content and pay. Nevertheless the sd Henry his promise aforesd not regarding but minding him the sd James in this behalf to deceive and defraud the said Sum of 926 Pounds of tobacco to the sd James hath not paid although often demanded, but hath hitherto refused and doth Still refuse to the damage of the sd James of 1800: Pounds of tobacco, and thereof he bring his Suit &c. --- Dent pr Quer. Pleg &c. Jno. Doe Rich: Roe The deft defends the force and injury and Saith that the plt is indebted to the deft as appears comparing accounts, and this he pleads in barr. of the action, and this is to be enquired of by ye Court.
