Excepted pr me. Edmund:Beauchamp. - - - - - Brought Over - - - - - - - - - - - - 916 1688. C Since agt June Court before mr. Aylward was Clerk - - - - - - - - - 044 960 The abovesaid nine hundred and Sixty pounds of tobacco pay unto mr. Edward Jones and his receit shall be your discharge from your Loving friend to power. Edm. Beauchamp = - - - - - - - - - - - - - - Declaracon and accompt produced in Court but no appearance of the Defendant. It is therefore Ordered by this Court that the sheriffe produce the sd Pope at our next County Court to be holden the Second tuesday August. Otherwayes judgment Issue agt the sd Sheriffe - - - - - - - - - - - - Edmund: Beauchamp. plt. Somerset County Ss. John:Tayler Attorney at Law was Sumoned Contra: to answer unto Edmund: Beauchamp of the same County Clerke John. Tayler. Defendt in an action of the Case. - - - - - - - - - - - - And whereupon the plt by James:Sangster his Attorney Comes and Sayes that the said John:Tayler deft is and stands indebted unto the plt. in the full and just Sum of thirteen hundred Seventy and five pounds of tobacco being the Ballance of accompt which sd accompt is here in Court produced, which sd Sum the sd deft, did assume and promise to pay to the plte yet Notwithstanding of the sd Assumption and promise, the said defendt fraudulently and craftily intending to deceive the plt of the same, hath hitherto denyed to pay and yett doth deny, to the plts great loss and damage to the value of two thousand Seven hundred and fifty pounds of tobacco, and there upon brings this Suite. --------- ---------- --------- Sangster per Quer. pled procs. Jno. Doe Rich: Roe Plea. Edmund:Beauchamp plt And the Deft in his own proper person Comes and defends the force and injury don and John:Tayler. defendt Saith. that the plt his action ought not to have for that the accont which the plt doth requ(ire) of the deft is not the just account of the deft, and thereupon puts himself upon ye Country John. Tayler. deft And the plt mentains the Declaration . B - - - James: Sangster. pr plt. Declaration and plea being read, Issue joynd the matter was referred to a Jury. And thereupon Comand was given to the Sheriffe to Sumons twelve good and lawfull men of his viconage that the matter might be the better known, a list or pannel of whose names are by sd Sheriffe thus returned viz. John:Emmett. Jno. Smock Wm: Henderson. Wm. Denson. Wm:Noble. Miles:Gray. Edward: Evins. Henry Hudson Senior. Bryan:Peart Thomas: Tull. James: Langrell.
