June ye. 12th. 1691 ( 116 ) - - - - - - - - - - - - - - Tull Maryland Ss. Know all men by these presents that we John Anderson and Thomas ^ both of the County of Somerset in the Province aforesd do acknowledge and confess our Selves to be firmly and justly indebted unto ffrancis: Jenckins high sheriffe of the County aforesd in the full and just Sum of twelve hundred pounds of good sound Mertable tobb. and Caske due to be pd unto the aforesd ffrancis: Jenckins, him his Heirs Extrers, joyntly & Severally firmly by these presents. As wittness our hands and Seals this 13th. day of September. 1688--- The Condition of this Obligation is Such that if the above bounden John:Anderson doth make his appearance at our next County Court to be holden the second tuesday in November, and there to answer unto Edmund Beauchamp in an action of the Case. then this Obligation to be void and of none effect Otherwayes to remain in full force power and virtue. Signed sealed and delivered John:Anderson. ? Sealed in presence of us C Thomas: Tull. ? Sealed Wm: Taylor: Roger: Burkam. November. ye. 14th: 1688. I underwritten do assign and Sett over unto mr Edmund Beauchamp all my Right and interest of the within mentioned Bond to his Only use & behoof as wittness my hand ye day & year abovesd ffra: Jenckins Declaration Bond and Assignment being Read, This Court Sheriffe having Considered the premisses. do Order. that Thomas Tull produce Jno.Anderson at our next County Court. Or the sd Tull to pay the Originall debt, being first proved by the sd Beauchamp. --- Edmund Beauchamp. plt. Somerset County Sc/ Teague Quillane of this County Planter was attached to answer Contra: unto Edmund Beauchamp. Clerke Assignee of mr. Wm: Brereton late high Sheriffe of Teague: Quillane. deft this County deceased in a plea of debt. &c. - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - And whereupon the plt by James: Sangster his Attorney Comes and sayes, That the said Deft Teague Quillane by his Instrument bearing date the sixth day of December Ano.Dom. 1689 Signed with the hand, and Sealed with the Seal of him the sd deft, in which sd Instrument the sd deft did firmly bind himselfe his Heirs Exters and Admrs to the sd mr Wm: Brereton decd. in the Sum of Sixteen hundred pounds of good Sound Mertable tobacco in Caske, to be to the said Wm: Brereton his Heirs, Extors Admrs or Lawfull Attorney truely contented and paid. The Condition whereof being Such that if John:Rousilla principall debitor to the plt do make his appearance before the Justices of the County Court next and imediate to be held the second tuesday in Janry after the date of y sd Instrumt then and there to answer unto Edmund Beauchamp ye plt in a plea of trespass on the Case, then the sd Obligation to be void and of none effect,now the sd plt declareth that upon the Second in Janry as sd is the abovesd Jno.Rousilla, did not appear by himself or Attorney according to the tenour of the sd Condition being three times called legally. Therefore Ordered the sd Wm:Brereton deceased, then high Sheriffe should in Open Court assign to the plt, the defts baile bond, and ye said defendt to be in mercy. The plt likewise saith that Notwithstanding of the sd Bond and Order of Assignment, the said Teague as Security as is aforesd, hath not payment according to the tenour thereof but fraudulently and Craftily intending to deceive the plt of the aforesd Sum of 1600lb. Pounds of tobacco hath hitherto denyed and yet doth deny to the plts great losse and damage to the value of 3200 lbs. of like tobacco, and hereupon brings this Suite. Ja: Sa. pr Qur: pled prsec Jno.
