June ye 11th: 1691 ( 104 ) - - - - - - - - - - Mr. Francis: Jenkins: Plt. Somerset County Ss. George Seaward and Walter Contra: ---------- Lane Exters of the last will and Testamt & Testamt Walter Lane & Seaward Defts of Josias Seaward decd were attached to answer unto - - - - - - - - - - - - - mr. ffrancis Jenckins of a plea of trespass upon ye Case And whereupon the sd ffrancis by Peter Dent his Attorney Complains that whereas the sd Josias in his life time (to witt the 12th. day of August in the year of our Lord 1687. was indebted to the said ffrancis in the sum of two hundred and twenty pounds of Porke as by a Certain note Subscribed with the propper hand of him the sd Josias here in Court ready to be produced may appear and the said Josias in his life time to the said ffrancis in manner aforesd being indebted, did assume upon himself and to the sd ffrancis faithfully promise that he the sd Josias the sd Sum of two hundred and twenty pounds of Porke when he should be thereunto requested would well and truly content and pay Nevertheless the sd Josias his promise & Assumption as aforesd not regarding but minding the sd ffrancis in this behalfe to deceive the said sum of two hundred and twenty pounds of Pork in his lifetime, nor the sd George and Walter Execcutors as aforesd nor either of ym to the sd ffrancis hath not paid to the damage of the sd ffrancis of 700: Pounds of Porke, and thereof he brings this suite &c. Dent. These Shall oblige me the Subscriber to pay or cause to be paid unto ffrancis Jenckins of Pocomoke River Gent, his Heirs or Assigns the just quantity of two hundred and twenty pounds of Porke as also Such Charges as may justly appear in a suit of presentmt made by the sd ffrancis Jenckins in the behalf of the Rt. Honble. ye Lord Proprietorie of Maryland &c agt George. Seaward of the County abovesd. In Wittness hereto. I have hereunto Sett to my hand this twelvth day of August ano D: 1687. Signed & dated in the presence of. Josias: Seaward. This is still due this 8th of March 1687/8. ----- ------- ---------- ---------- Josias: Seaward ---------------- Proved pr ye Oath of mr Jenkins in Open Court that he had recd no part or parcell of ye above sd Porke Order granted according to Declaracon. agt Walter Lane. &c. William: Willmott plt. Somerset County Ss. George: Seaward and Walter: Lane Extrs of ye Contra: last will and Testament of Josias: Seaward decd were attached to Seaward & Lane. defendts answer unto Willmott Mercht. of a plea of trespass upon the Case &c. - - - - - - - - - - - - - And whereupon the sd William by Peter: Dent his Attorney Complaineth that whereas the said Josias the last day of August in the year of our Lord 1689. in his life time at Monokin within the Jurisdiction of this Court was indebted to the said Wm. in eighteen bushl and one Peck of wheat as by a perticular accompt thereof here in Court may appear. And the said Josias to the sd Wm. in manner aforesd being indebted did assume upon himself, and to the sd Wm. faithfully promise that he the sd Wm would content and pay. Nevertheless the said Josias in his life his promise and assumption not regarding but minding him the sd Wm in this behalf to deceive the sd wheat, to the sd Wm hath not paid, nor the sd George & Walter Extrs as aforesd nor any of them hath not pd to ye damage of sd Wm. of 1600.
