And be it enacted, That any person violating any of the provisions of this Act, shall, on conviction there- of, be fined in any sum not less than two dollars, and nor more than ten dollars for each offence, with costs of prose- cution; and all prosecutions under this Act, shall be in the name of the State, before any Justice of the Peace of the Election District in which such violation may occur ; and of all fines when collected under this Act, one-half shall be paid to the informer, and' the other half to the School Commis- sioners of the county, to be applied by them to the support of the public schools of said county. Section 4. And be it enacted, That the possession, by any person, within said county, of any of the birds protected by this Act, as shot, killed or otherwise destroyed, shall be prima facie and sufficient evidence to make such person lia- ble for the fine for the violation of the provisions of this Act; and it shall be the duty of all Constables of said county, to arrest all person they may detect in, or who maybe charged with the violation of any of the provisions of this Act, and take then before the nearest Justice of the Peace, to be dealt with as directed by this Act. Section 6. And be it enacted, That this Act shall take ef^ feet from the date of its passage. Which were severally read. When, On motion of Mr. Phillips, The further consideration thereof was. postponed, and the bill, with proposed amendments, recommitted to the Frede- rick delegation. The bill, entitled an Act to authorize the State's Attorney ^ of Baltimore City to pay out of the excess of the fees of his. * office such sums of money to the State's Attorney of Anne Arundel county as may be fixed by the Circuit Court for Anne Arundel county, as compensation in the cases of the State of Maryland vs. E. G. Wharton, removed from the Criminal Court of Baltimore City to the Circuit Court for said county, Being upon a second reading, Mr. Miller moved that the enacting clause of the bill be- stricken out. Decided in the negative. Mr. Cooper submitted the following amendment : AMENDMENT PROPOSED. Insert in section 1, line 6, after the word "county" the words, "Provided the amount shall not exceed five hundred; dollars." |
