fire and for the health and convenience of the in-
habitants thereof; therefore,
SECTION 1. Be it enacted by flu' General Assembly of
Maryland, That the Mayor and Council of Hagerstown":
town be and they are hereby vested with full power
and authority to provide for the said town any soil
water that may lie necessary for a full supply for
said town, and to provide for the use of the same,
and the same to convey in such manner and direc-
tion as they may deem most suitable and proper; to
establish and construct receivers and reservoirs, and
other works which they shall deem necessary for the
conveyance and distribution of said water, on any
land or lands of any person or persons whomsoever,
through whose lands it may bo necessary to convey
said water, on purchasing the same from the owner
or owners thereof by the said corporation; provided,
that the mode and manner of introducing and con-
veying said water, and all contracts touching the
purchase of water or water-rights, as well as the
purchase of lands, or rights of way, pipes, ma-
terials, & ('., required for the complete construc-
tion of said water-works, shall be approved of'
by the Water Board hereinafter appointed; and ii'
tie owner or owners of such land or lands be a mar-
ried woman, under age, non compos mentis, or under
any oilier legal disability to contract for a sale of any
of said lands; or if being of age and competent to
contract should be unwilling to make such sale, or
cannot agree with the .-said corporation on the terms
of sale, in either or any of said cases any one of the
Judges of the Circuit Court for Washington county,
on the application of the said corporation and Water
Board, shall pass an order directing the Clerk of
Washington county to issue a commission to three
disinterested persons, named in said order, to value
such land or lands as shall be required for said pur-
pose, who shall make return thereof to said Circuit
Court at the term next ensuing the issuing of said
commission; but before the said commissioners shall
value such land they shall take an oath, to be en-
dorsed on or annexed to said commission, to execute
the trust reposed in them without favor, partiality or
