LAWS OF MARYLAND.
SEC. 11. And be it enacted, That if any person shall
encroach upon any public road by fences, dirt,
bridges or other obstruction, or shall purposely de-
stroy or injure any guide post or guide boards, or
dig any ditch or drain across any road, and not keep
such ditch or drain secure and well covered and in
good repair, for the passage all vehicles over the
same to the full width of said road; or if any person
shall drain any water into or upon any public road,
each and every such person for every such offence,
and for each and every day any such ditch or drain
shall he suffered to remain out of repair and inju-
rious to such road, shall be liable to be sued in any
action of debt before '-i Justice of the Peace, in the
name of said commissioners; in which said action
the amount recoverable shall not be less than five
nor more than fifty dollars, either party having the
right to appeal to the Circuit Court as in other cases
small debts, and the sun-is recovered in any such
action to be applied in the same manner as herein-
before provided.
SEC. 12. And, be it enacted, That it shall be unlaw-
ful for any of the said Comity Commissioners, under
any circumstances whatever, to engage or be inter-
ested directly or indirectly, either in person or by
proxy, or otherwise, in any contract or agreement
for the repair or construction of any road or bridge
partly or entirely within the limits of said comity;
and if any of said commissioners shall so engage in
or have any interest directly or indirectly, in person
or by proxy, or otherwise, in any contract or agree-
ment for the repair or construction of any such road
or bridge, he shall be deemed guilty of a misde-
meanor in office, and liable to indictment therefor in
the Circuit Court for said county, and on conviction
shall be removed by said court from said office, and
pay a fine of not less than twenty-five nor more than
fifty dollars, in the discretion of said court.
SEC. 13. And be it enacted. That the several supervisors shall report semi-annually, in June and No-
vember, to the County Commissioners the state of
the roads within their districts, and the expenses by
them incurred under this law; the amount of money
