being convicted thereof before any Justice of the
Peace in Carroll county, or by the oath or affirma-
tion of one or more witnesses, forfeit the fine or
fines named in this Act, one-half to the use of the
school fund of the county, and the other half to the
use of the informer; and if the offender, after being
convicted of the crime, shall refuse to pay the said
fines, so imposed by this Act, he or they shall he
committed to the jail of the county for every such
offence for the space of ten days; provided, however,
that such conviction shall be made within sixty days
after committing the offence.
SEC. 5. And be it enacted, That it shall be the duty
of the constables and bailiffs of the several election
districts of the county, or the wards of the several
cities, to arrest all persons whom they see violating
any of the sections of this Act, and take them before
the nearest Justice of the Peace, to be dealt with as
this Act directs.
SEC. 6. And be it enacted, That any person or per-
sons who shall shoot, kill, or destroy any hawk or
big owl, shall, by taking the said hawk or owl}, or the
head of said hawk or owl, before any Justice of the
Peace of said county, as evidence of said killing or
destroying, [shall] receive an order upon the tax col-
lector of Carroll county for the sum of twenty-five
cents, and the said tax collector of Carroll county
shall pay and return the same as he would money
paid for any other purpose, and the said Justice of
the Peace shall destroy said head, so it cannot again
be used, fraudulently.
SEC. 7. And be it enacted. That this Act shall take
effect from the date of its passage.
