one year nor more than five years, unless the amount
for which he is a defaulter be sooner paid, and the
certificate of the Comptroller of the State of Mary-
land, or of the respective Clerks of the County Com-
missioners, showing the accused to be a defaulter,
shall in every prosecution under this section be re-
ceived as prima facie evidence of such defalcation,
and the Judges of the Courts having criminal juris-
diction in this State shall give tins law in charge to
the Grand Juries summoned to (their respective
Courts.

CHAPTER 331.
AN ACT to appropriate a sum of money to pay the
claims of B. Duncan Smith, Thomas S. Nutwell,
John Murphy and Company, Maryland Steamboat
Company, James M. Anderson and Son, Michael
and Brother, James E. Tate, Sprigg Harwood,
Samuel Stewart, Wheelwright, Mudge and Com-
pany, John A. Dunbar, and Mrs. Maria L. Bigger.
SECTION 1. Be ii enacted by the General Assembly of
Maryland, That the Comptroller be and he is hereby
requested and directed to issue Ins warrant upon the
Treasurer to pay to B. Duncan Smith, late Collector
of Anne Arundel county, for taxes overpaid, as per
certificate of the Comptroller, thirty-seven dollars
and sixty cents; to Thomas S. Nutwell, late Collec-
tor of Anne Arundel county, for taxes overpaid, as
per certificate of the Comptroller, fourteen dollars
and eighty-two cents; to John Murphy and Com-
pany, for stationery furnished the General Assembly
of eighteen hundred and seventy, five hundred and
sixty-six dollars and four cents; to the Maryland
Steamboat Company, for freight on chairs for Senate
