SEC. 3. And be it enacted, That nothing in this Act
contained shall be taken or construed so as to affect
any licensed tavern-keeper, merchant, shop-keeper,
farmer, or other persons, in the usual and lawful
transaction of his or her ordinary business, in the
usual place of transacting such business, or to any
person having permission in writing from the super-
visor or supervisors of such festival or picnic, to sell
such articles as may be named in such permission.
SEC. 4. And be it enacted, That all fines imposed
and collected under this article, shall be paid to the
Treasurer of the School Board of Worcester county,
for the benefit of the school fund of said county;
and nothing in this article shall prevent the Courts
of record from exercising their common law juris-
diction in all cases, and the party convicted under
any of the preceding sections relating to festivals
and picnics, shall have the right to appeal to the
next Circuit Court for Worcester county, upon giv-
ing bail for his appearance at Court, and upon such
appeal shall be entitled to a trial by jury.
SEC. 5. And he it enacted, That this Act shall take
-effect from the date of its passage.

CHAPTER 201.
AN ACT to make valid the action of the Local
Board of Supervisors, of the first road district of
Baltimore county, in condemning and opening a
road for public travel leading into the Frederick-
town Turnpike Road in Baltimore county.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That the action of the Local Board of Su-
