LAWS OF MARYLAND.
gatherers, as they shall think proper, to collect and
receive of and from all and every person using the-
said road, such tolls and rates, as the President and
Directors may think just and expedient, not exceeding
however, the tolls and rates above prescribed, and
authorized by this charter 'to he charged, and to stop
any person riding, leading or driving any horses,
cattle, hogs, sheep, or any kind of chaise, cart, wagon,
sled, sleigh, carriage, buggy or other vehicle of
pleasure or burthen, from passing through said gates
until they shall have paid the same.
SEC. 10. And be it enacted, That if any person or-
persons whosoever, riding, driving or leading any
animal or thing for which tolls are prescribed by this
Act, shall pass through any private gate or bar pas-
sageway, or other ground, with the intent to defraud
the said company, and avoid the payment, of the toll or
duty for passing through any of its gates or turnpikes,
such person or persons in all or any of the ways or
means so offending, shall for every such offence, re-
spectively forfeit and pay to said company, any sum
not less than ten dollars, nor more than twenty
dollars, to be sued for and recovered with costs of
suit, before any Justice of the Peace, in like manner
as debts of a similar amount may be sued for and
recovered, and with a right of appeal, as in such
cases.
SEC. 11. And be it enacted. That this company during
the construction of said road, has the right to close
said road to travel, when in their judgement such travel
will work an injury to said road.
SEC. 12. And he it enacted. That so soon as the said
company shall have perfected the said road they
shall give notice thereof to the Judges of the Circuit
Court for Carroll county, who shall thereupon forth-
with nominate and appoint three judicious persons;
to view and examine the same, and report to them
in writing whether the said road is so far executed
in a masterly workmanlike manner according to the'
interest and meaning of this Act; and if their report
shall be in the affirmative, then the said Judges, or any one of them, shall, by license under their or his,
