more eligible positions or locations, and whenever a
new road shall be opened as a public highway in
either of said counties, the Supervisor of the district
shall cause all gates to be removed therefrom.
SEC. 2. And 'be it enacted, That any person who
shall violate the provisions of the preceding sections
of this Act, shall pay a fine of twenty dollars, to be
recovered by action of debt, before a Justice of the
Peace, in the name of the County Commissioners, to
be applied to the road fund of the county; and any
Supervisor, who shall fail or neglect to perform his
duties under the provisions of this Act, shall forfeit
and pay a fine of twenty dollars, to be recovered in
the same manner and applied to said fund.

CHAPTER 162.
A.N ACT to repeal section seventeen, of article
ninety-six, of the Code of Public General Laws,
title Weights and Measures, and to re-enact the
same with amendments.
SECTION 1. Be it enacted by the General Assembly of
Maryland, That section seventeen of article ninety-
six, of the Code of Public General Laws, entitled
" Weights and Measures," be and the same is hereby
repealed and re-enacted, as follows:
SEC. 17. Oats shall be bought and sold in this
State by struck measure or by weight, at the rate
of twenty-six pounds to the bushel.
SEC. 2. And be it enacted, That this Act shall take
effect from the date of its passage.
