LAWS OF MARYLAND.
from the main road, not over twenty feet wide, in the
City of Baltimore, and sixty feet in Baltimore county,
not exceeding two hundred yards in length in the
City of Baltimore, but not until the consent of the
Mayor and City Council of Baltimore has been first
obtained, and one mile in length outside of the limits
of said. city, as may be necessary to enable it to shift
trains to and from. other railroads with which it may
now or may hereafter come in contact with, between
the termini now fixed by the Act incorporating the
said company, and any Act amendatory of or supple-
mentary thereto; and in constructing its road said
company may tunnel by open cut or drifting, and in
regard to the construction of its road and all other
matters not specially provided for by this and former
Acts, relating to the said company, its powers shall
he the same, and exercised in the same manner as
those of the Baltimore and Potomac Railroad Com-
pany.
SEC. 6. And be it enacted. That the said President
and Directors, or their agent or agents authorized by
them, may agree with the owner or owners, whether
natural persons or corporations, of any land, earth,
stone, gravel, timber, streams, improvements, fran-
chises, or other property of any kind, which may he
wanted by the said company, for construction or
repair of its road, buildings, switches, sidings, or
other works, or equipments, for the purchase in fee,
or for a less interest, use and occupation or diver-
sion of the same, and if they cannot agree, or if the
owner or owners of any of them be an infant, feme
covert, unable to contract with reference to the same,
won compos mentis, or out of the county, or City of
Baltimore, where such property may lie, when the
same may be wanted, or for any cause be incapable,
of contracting, application may be made to any
Justice of the Peace of such county, or the City of
Baltimore, as the case maybe, in which such property
wanted may lie, who shall thereupon issue his warrant,
under his hand and seal, to the Sheriff of the county
or City of Baltimore, as the case may be, in which
. the property wanted may be, requiring him to sum-
mon a jury of twenty of the inhabitants of said county,
or City of Baltimore, as the case may be, above the
