elections required to be held by said company at any
particular time, may be held at any time within
thirty days thereafter; and, if any vacancy shall oc-
cur, in any manner, of any President or any Direc-
tor, during the year for- which lie was appointed or
elected, the Board of President and Director!-!, or a
majority of them, may, if such vacancy 1& among the
elective Directors or President, appoint, and this
person to fill the office for the residue of the time;
but if the vacancy be in those appointed by the Mayor
and City Council of Baltimore, then such vacancy shall
he filled by it in the manner before set forth for the
appointment of directors on its part, and at all annual,
and also at any called meetings, if so required by any
stockholders or endorsers of bonds, or by the Mayor
and City Council of Baltimore, the President and Direc-
tors shall furnish a clear and itemized statement of the
earnings, expenses, and financial condition of the com-
pany up to that period, or the close of the fiscal year,
which shall be the thirty-first day of December in each
year, but the Mayor and City Council of Baltimore
shall not be entitled to vote at any regular or called
meeting of the stockholders, or endorsers or guaran-
tors of the bonds, its representation being only in the
Board of Directors in manner stated; provided, how-
ever, that this and the preceding section of this Act
shall not become operative until the Mayor and City
Council of Baltimore shall have consented that its
representation In the said company shall be reduced
to two members in the Board of Directors, and until
the said company shall have released to the Mayor
and City Council of Baltimore all right to any further
endorsement of bonds by said Mayor and City Coun-
cil of Baltimore.
SEC. 4. And be it enacted. That nothing contained
in any of the Acts of Assembly relating to the said
company shall be construed as preventing the said
company from using its own locomotives and cars
upon its road, on equal terms, however, with other
companies having the right to run their locomotives
and cars upon the same.
SEC. 5. And be if enacted. That the said company
may construct all switches and sidings or turnouts
