in case of a second or other disagreement of the
jury, the same proceedings shall be had until a ver-
dict or inquisition shall be made and returned, as
aforesaid.
SEC. 3. And he it enacted, That whenever the said
company shall find it necessary to change the loca-
tion or grade of any part of its road, whether here-
tofore made or hereafter to be made, it shall be
authorized to make such changes, not departing
from the general route indicated in this and the other
Acts relating to said company, and for such purpose
said company shall have the same powers for the
acquisition of land, materials and all other property,
and to be exercised in the same manner as stated in
the preceding section.
SEC. 4. And he it enacted, That if it shall be neces-
sary for said company to occupy any part of any
road, street, alley, or public way or ground of any
kind, it shall be competent for the municipal or
other public officers or authorities owning or having
charge thereof, and the said company, to agree upon
the terms and conditions on which the same may be
occupied; and in case they are unable to agree said
company may appropriate so much of the same as
may he necessary, in the same manner and on the
same terms as is provided for tire appropriation of
the property of individuals by the second section
of this Act, provided, however, that tire Mayor and
City Council of Baltimore, or any other municipal
authority in this State, shall always have power to
settle and determine the mode of the construction
and use of the said railroad within the limits of the
City of Baltimore, or any other city in this "State.
SEC. 5. And be it enacted, That in order to enable
the construction of the branch of said road to the
grounds of the Maryland Agricultural Society, the
said company may issue capital stock and bonds of
the said company to bo designated the " Pimlico
Branch Stock," or bonds to such amount as the
President and Directors may find necessary to con-
struct, equip and from time to time repair said branch,
and its necessary or convenient buildings and equip-
