and repair of a railroad from the western end of the
tunnel now in course of construction by the Baltimore
and Potomac Railroad Company, or from some other-
suitable and convenient point in the City of Balti-
more, to be by tire said President and Directors
determined, to Williamsport or any other point in
Washington county, or to Cumberland or any point
westward or northward thereof, not exceeding sixty-
six feet wide with as many sets of tracts as may be
deemed advisable by said President and Directors;
and also for the construction of lateral railway from
any point on the main line of said railway to the
grounds of -the Maryland Agricultural Society, in
Baltimore county, not more than sixty-six feet in
width, and as many sets of tracts as may be deemed
advisable, together with all buildings, stations, tanks,
switches and other works, accommodations and
equipments necessary or convenient for the opera-
tion of said main and lateral railway, and tire present
selection of a terminus should not effect the power
afterwards to extend to said railroad further, as here-
inbefore provided, and the said President ana. Direc-
tors may contract with any person or persons for the
construction of said railway or any part of it, and
they, or their agants, or any persons with whom they
may contract for making of tire same, may enter upon
and use and excavate any land, earth, gravel or
other materials which may be required for the con-
struction and repair of said railway, or the erection of
warehouses or depots, switches, turn-tables, workshops
or other works necessary for the road, or for any other
purpose, necessary or useful in the construction or
repair of the road or its works, prodded, however, that
the said President and Directors shall first agree
with the owners upon the compensation, if any, to
be paid for the land or materials to be taken, or shall
pay and tender just compensation for the same, to be
ascertained as hereinafter stated.
SEC. 2. And he it enacted. That the President and
Directors, or their agent or agents authorized by
them, may agree with the owner or owners of any
land, earth, gravel, stone, timber, waters, ways, ma-
terials or improvements, or other property, which
may be hereafter wanted for the proper construction
