CHAPTER 67.
AN ACT to prevent swine from running at large in
the streets, lanes and. alleys, contiguous to Burkittsville, in Frederick county.
SECTION 1. .Be it enacted by the General Assembly of
Man/land, That it shall not be lawful for an) person
to allow Ins, her or their swine to run at large in the
roads, streets or alleys, within one-half of a mile of the
square in the village of Burkittsville, under a penalty,
to the owner or owners thereof, in the sum of fifty'
cents for each swine found within the limits afore-
said.
SEC. 2. And be It enacted, That if any person finding
any swine going at large within the prescribed limits
of the first section of this Act, and furnish such in-
formation under oath or affirmation, together with the
name of the owner, to a Justice of the Peace in
Petersville district of Frederick county, the said
Justice of the Peace shall issue a summons to the
owner or owners thereof, to appear before him to
answer in a plea of trespass, and if it shall appear upon
satisfactory proof, that the swine of such person or per-
sons, charged in the summons, has been found within
the limits prescribed in the first section of this Act,
the Justice of the Peace shall render judgment against
the owner or owners thereof, in the sum prescribed
in the first section of this Act, together with all costs
incurred, to be collected as other small debts.
SEC. 3. And he it enacted, That it shall be lawful
for any person or persons finding swine running at
large in violation of this Act, to impound such swine,
and after giving five days' notice by writing, in at
least two public places in Burkittsville, he, she or
they may sell such swine to the highest bidder for
cash, and should said swine be claimed by the owner or
owners thereof, he, she or they shall pay twenty-five
cents for every day said swine has been impounded,
together with the fine and cost as prescribed in the
first section of the Act, and in default of payment of
the said fine and impounding fee, the said swine may
be sold to satisfy the same.
