"And, provided further, that the transfer is made upon
the further condition, that not less than sine miles of said
road shall be located in the State of Maryland, and that the
whole of said sum of forty-eight thousand dollars shall Ie
used in the construction of that part of said road which shall
be located in the State of Maryland, and not more than six
thousand dollars thereof shall be applied towards the con-
struction of any one mile of said. road.
