By-laws.
|
Sec. 8. And be it enacted, That the Directors of
said Company shall have power to make and adopt
such by-laws, rules and regulations for the direc-
tion and management of said Company as may in
their judgment be necessary for the purposes of
their incorporation, not inconsistent with the pro-
visions of this charter and the laws and Constitu-
tion of this State; and the President and Directors
of said Company, or a majority of them, shall con-

stitute, appoint and employ such officers, agents
and servants for the construction, preservation and
repair of said road, and for the receipt and collec-
tion of tolls, and the transaction of all other busi-
ness of said Company, as in their judgment may
be necessary.

Avoid paying
toll.

Sec. 9. And be it enacted, That if any person or
persons whatever, riding or driving anything
whatever, or leading the same, shall therewith pass
through any private gate or bar, or turn off said
road with the intention of avoiding the payment
of toll for passing through such gate, and all and
every person so offending shall for every such
offence forfeit and pay to the said President and
Directors a sum not exceeding twenty dollars, to
be sued for and recovered with costs of suit, before
any Justice of the Peace, in like manner as debts
of similar amount may be sued for and recovered;

Penalty for
over charge.

and if any toll-gatherer shall demand and know-
ingly receive any greater toll than he is authorized
to receive by this Act, he shall forfeit ten dollars
for every such offence for the use of the county in
which the offence occurs.

Injure or im-
pair.
|
Sec. 10. And be it enacted, That if any person
or persons shall wilfully, by any means whatso-
ever, injure, impair or destroy any part of said
road, or any of its necessary works and buildings,
or place any obstructions on said road, or if any
person or persons shall effect or attempt to effect
an entrance through any toll gate on said road, by
force, violence or intimidation, such person or per-
sons so offending, shall be subject to indictment in
the Circuit Court of the county in which the offence
occurs, and upon conviction of such offences, shall
be punished by fine and imprisonment in the dis-
cretion of the Court.
