such penalty, and with such security, as they may fix and approve, and with such conditions as they may prescribe in regard to the duties to be per- formed, the use, safekeeping, and due return of all property placed in their charge, and the proper disposal of all monies coming into their hands for road purposes. 95. The said County Commissioners, if in their judgment it is expedient and proper, may raise in advance such an amount or amounts as may be sufficient for the proper repair and improvement of the public roads of said county, by negotiation of a loan or loans upon the bonds of the county, at not less than their par value, bearing six per cent, interest, payable annually, and said bonds payable in annual installments, in such order as may ren- der their payment not oppressive to the tax payers	Negotiate loan
of said county; and they shall provide in their an- nual levy for the payment of said interest and of said annual installments, until said bonds shall be fully paid off and redeemed.	Annual levy.
96. If in the construction and repair of the public roads of the county, it be necessary for the proper drainage of said roads, it shall he lawful for Supervisors or other road officers of the county to let off the water therefrom upon the adjoining lands, at such places as may be proper and neces- sary;provided, it shall be done with as little injury as possible to the owners of said lands, and provided the drains through such lands be con- tinued so as to prevent the spreading of the water so let off the roads over cultivated fields. 97. Any person who shall obstruct, fill up, or otherwise wilfully injure the drains made for con- ducting the water from the public roads, or shall encroach upon any public roads by fences or other obstructions, or dig any ditch or drain across any road, and not keep such ditch or drain well cov- ered and in good repair for the passage of vehicles over the same, or if any person shall drain any water into or upon any public road, each and every	Obstruct or injure.
such person, for every such offence, shall be sub- ject to a fine, for the use of the county, of not less than ten nor more than one hundred dollars.	Fine.
