and Directors shall have power to remove and dis-

to pass by-laws to regulate all matters in connec-

that such by-laws do not contravene the laws or
policy of the State of Maryland.

Sec. 11. And be it enacted, That the President
and Directors are hereby invested with all the
powers necessary for the location, construction, re-
pair and operation of a line of railroad with a width
of sixty feet from a point on the Western Maryland
Railroad, at or near Union Bridge, in Carroll
County, or from some point on said railroad, to be
determined by the President and Directors, west
of Union Bridge, to the town of Liberty, in Fred-
erick County.

Sec. 12. Be it enacted, That the said President
and Directors, or their agent or agents authorized
by them, may agree with the owner or owners of
any land, earth, gravel, stone, timber, streams or
materials, or. any improvements which may he
wanted for the proper construction or repair of said
roads, or any of their works, for the purchase and
use and occupation or diversion of the same; and
if they caiinot agree, or if the owner or owners of
any of them be an infant, feme covert, who is not
possessed of the property to her sole and separate
use, or authorized to contract in reference to the
same, non compos mentis, or out of the county where
such property wanted may lie, when such property
may be wanted, or for any other cause be legally
incapable of contracting, application may be made
