able and capable at law and in equity to sue and
be sued, plead and be impleaded, and to hold,
take and enjoy to them and their successors, for

 

the use of said Central Chapel and Cemetery, any
estate in lands and tenements, goods and chattels
and effects, by gifts and grants, conveyance, de-
vise or bequest of any person or persons whatso-
ever; provided, the whole of their property shall
not at any one time exceed the sum of ten thousand
dollars ($10,000), and the same to use in any man-
ner they may deem most beneficial to the said
church and cemetery.

Powers.

Sec. 3. And be it enacted, That the said Trus-
tees and their successors may have, hold and enjoy
the donations and purchases from Cordelia H.
Downey, Benjamin Nelson, Henry Nelson and Dr.
John S. Reese, heretofore made to the said church
and cemetery, according to the true, intent and
purpose of the same, and for the benefit of said
church and cemetery.

Sec. 4, And be it enacted, That an election, by
ballot, for seven Trustees shall be held at Central
Chapel some day between the first and tenth day
of August next, and between the same days of the

tees, in such manner as they may direct, and that
every legal voter who is a member of said Central
Chapel Church, or who contributes to the support
of the Gospel at said church, together with the

Sec. 5. And be. it enacted, That in case any of
the said Trustees die, resign or refuse to act, or
remove to a distance of five miles from said Central
Chapel, the remaining Trustees shall fill up the
vacancy or vacancies.

Sec. 6. And be it enacted, That if such annual
elections for Trustees as herein provided should
not take place, that the said Trustees under the
appointment of this Act and their successors shall
hold over until an election of successors, and shall
enjoy any and all the powers with which they are
hereby vested.
